Ok Guys, Back on Wednesday June 30th., I spoke with a guy in Middletown, MD and was inquiring about a 3.42 rear end that he had for sale on The Forum for $350.00. I wrote him back inquiring about the condition of the rear end because I knew it was a pretty good deal for that price since they are going for around $500.00, he said it did not need it to be rebuild. Here is what he wrote back:

Its in great condition and does not need rebuilt. If you want to ask me any questions u can contact me at (XXX)XXX-XXXX.

I went ahead and sent him a check, He cashed it and sent Rear End. Well when I received the Rear-End, I called him right away and took picture of it. It arrived with a crack, he said it was perfect when he shipped it..........at that point I wanted my refund and he said I had to deal with UPS since it wasnt his fault, So I started to take the Rear End apart and I found another problem.......The inside was in worst shape, so I took pictures of all the broken internal parts and email them to him, Again he told me that the Rear-End was perfect. So I finally get in touch with him and he tells me his best friend was killed........By now I dont believe a word he tells me. Now Im out $375.00 + I have a Rear End that its worthless..........

I been around the forum for a while and I dont know if anyone knows this guy. I try to call UPS and they told me that the shipper has to make the claim, but he is not willing to take it back and file a claim with UPS..............I have shipped items through UPS and Fed-EX and if something happens to them, I have filed the claim since I was the shipper and also received my money back.

I get a feeling this guy just wanted to take someones money and run. What would you all do in this case. I have his phone number and address, I have called him and left messages. He told me last time we talked that he didnt have the tracking number so he could not file a claim, I emailed him the number and Im getting ignored.

Was the packaging damaged or was there any indication it had been dropped? If there were internal problems too, I doubt it got damaged in transit. If he is claiming that it was perfect when he sent it and you paid by check, probably your only hope is to convince him to file a claim. That is, assuming he really shipped it insured. I don't know how the insurance works, but maybe talk to UPS and tell them that the sender refuses to make a claim and ask them what recourse you have. Maybe they'll help.
