I placed an order with a local dealer (low volume) the beginning of October, it was entered in the system (checking found it at 1101). The dealer did not have an allocation to attach to the order.
Two days ago I found a car that matched my specs. I told my original dealer I was going ahead with that deal in place of waiting for an allocation. Of course as Murphy would have it, he received an allocation the next day and now is refusing to refund my deposit since I broke the deal.
My position is we never really had an order since it was not picked up by GM and did not have an allocation assigned to it. Your thoughts and opinions please

Based on your responses to many of the thoughts and opinions that have been offered, it doesn't seem like you wanted any that differ from your own.
OP, if your dealer will still honor the discounted price that was verbally agreed upon, why not just complete the order/purchase
and be done with it ? You only have to wait a few more weeks for the car...

First never enter an agreement if the despite is non refundable. PERIOD, if you do then things like the above can happen. I have a Z06 on order ( currently at 3300 status) and my deposit (1k only) was not taken until my order was placed against my allocation on 9-20-14. I had my name on the dealer waiting list since 1-15-2015 without a dime down. I wish you luck...
Well, I guess that could be a take away from this discussions, but there were lots of conversations I that I could not enumerate here (far to many).
I'll close the discussion by offering this: in two separate emails two days before I purchased an out of state car, the Sales Manager who I told about those discussions, said to me; "If you find one that works for you I understand you going for it", and later in the day he responded to an email with "Ron what works best for you is fine". While neither of those addressed my deposit they sent a pretty clear message to me that the dealership, as represented by the Sales Manager, was okay with me bailing out on my "order".
That was my interpretation but it might not be shared by my CF colleagues.
