Get the regional sales field mgr involved, it will be uncomfortable for that dealer and you will probably get a new car ordered and expedited to a new dealer. At least that's what I did as a regional rep....happened a few times.....

A civil action on your part is necessary. The dealer had all the paperwork to show it was your car but they sold the car to someone else anyway. You are in titled to damages. Hire a lawyer.

Can't blame you for being pizzed at that dealer. I too would explore legal options and certainly would look at doing business with another dealership anyway.

Okay, perhaps not viable or legal but you got my wheels turning...

If you got the VIN and GM thinks you own the car you should be able to setup the onstar app, right? Set off the horn. Maybe start the thing. Maybe both. They'll either call Ghost Busters or take it to the dealer complaining of freakish glitches. Repeat often. Might be even more fun with your phone than playing Candy Crush.

Stop with the phone calls and e-mails. If you want to get somewhere, show up in person and demand resolution. Given that you received all of the "start up" notifications, it definitely sounds like they sold the car out from under you to a buyer who was offering more money. I typically say drop it and move on in these types of situations, but this is exceptionally ridiculous behavior from the dealer.

This is very good advice, dealers don't give a crap about remote inquiries, get down to the dealership after calling the GM regional office and demand a sit down with the Gen mgr (Nothing less) and the area market manager.

I'm gonna guess there's really nothing that can be done except lick wounds and order another from somewhere else. Maybe you can go for mental anguish? It has to be extremely frustrating.

If you order from a forum dealer and do courtesy delivery, this sort of thing is impossible because you own the car before it even gets to the dealer.

BTW, if you don't think you wanna play with the Onstar app, you might see if you can cancel your Onstar and XM with the existing car asap. You know, shut it off even though it's still in the trial period.

I had the GM the salesman and the guy who places the orders in the same room. It was very uncomfortable for them. I am in the process of getting it resolved. I will keep you posted.

If you can find the car and it matches your order, then you have a shot at legal recourse. If GM says it is your car, 1) the order was placed. 2) your name was on the order. 3) the car was delivered to the dealer as your order. 4) this would be a fraudulent sale or theft. 5) get all your paperwork together, deposit receipt, order conformation and date of order entry. All this will have your car with the listed options, color, wheels and trim level. Get a lawyer and nail the SOB's.
But be sure all of your ducks are in a row, the dealership has a lot of money and a lot more vested in this than you do. If you win, bye bye dealership hello grey bar hotel.
Someone posted that GM doesn't care and that all they care about is selling cars. While it is true that they care about selling cars I can assure they do care. GM can not afford to have their dealer franchise stores not be on the up and up. Having a dealership make national news for selling someone else's ordered vehicle would not be good for GM's image. This is surely something that GM would be very concerned about. The dealer is never going to admit to doing anything wrong and will probably have lost the paperwork for your order. Which will be of interest as they would not have any proof that they ordered the car for stock as opposed to ordering for you. When the orders are placed in the GM ordering system GM gives it an order number, that is the way it is found in the GM system.
I am thinking that you have a very good case for legal action...assuming the car you are talking about matches the car you ordered.

Notify GM about your order concerns. GM does care but in reality can not trace every vehicle that is produced from the assembly line to end user. Legal; the cost to litigate adds up fast and there is no guarantee of a successful conclusion. If you got your deposit returned (really only solution) consider the transaction closed and move on to another dealer.

Yet another true example of a Stealership. At the very least, post horrible reviews for this Stealership on every social media you can think of, Google +, Cars.com, Cargurus.com, Dealerreviews.com, etc. Maybe if you have the time take them to small claims court and get a few thousands out of them for your troubles. Case is too small for a lawyer to be enriched.

I would opt for museum delivery. I would think they would not let someone else drive off with your car.

Something about an order mix up and how the dealer buys the car. So I send all the emails to the dealer and to GM and wait. On 5/30/15 a Fedex truck pulls up to my house and drops me off a pachage from GM. It's my Welcome to the team package complete with the $1,000 track experience voucher. STILL NO VET!!! I storm down to the dealer demanding to know what is going on. He said the car was not going to be built and I had to order a 2016 model and start the process all over. NOT!!! I asked for my depost back, went home. Logged into the owner center site and got the VIN# for my car that I never received and googled the number and yup, you guessed it. It was deliverd to the dealer but to a diffrent store and sold to someone else. Can you belive this!!GM needs to sink these guys. This has put a big dark cloud over an experience that I have looked forward to for a very long time.

I sincerely doubt that legal action would go anywhere. The OP never owned the car. Deposit does not equal "ownership". He could sue, but what would be his "actual damages" i.e. his real losses be? Since he got the deposit back the financial loss is zero. "Mental anguish" because he didn't get a Corvette? As much as I sympathize and completely understand how screwed I would feel in that situation, the judge would probably laugh at him and he would have ended up paying a lawyer for nothing.

Legal action is probably both expensive and pointless.

The folks that were advising to see if you can get GM to process an expedited order through a different dealer is probably about the best that can be done.
