Default Refusing a delivered special order C7

Folks,

I am getting cold feet after ordering a new C7. When the Vette comes into the dealership can I refuse it and just lose my deposit, a whopping $500.00? It was ordered on 11 March.

Thanks

If you had ordered the vehicle from me and the car is due to come to the dealership I would refund your money with no explanation needed. People have life changing events and who am I to keep their deposit for the dealership with out accepting the vehicle they clearly would love to own. I do it many times per year without hesitation. * I would be honest with the dealer sooner then later and he should appreciate your honesty.

I think you should notify the dealer now that you have changed your mind. Depending on where it is in the order to production cycle, they may be able to change the order to something they feel they can sell easier.

Maybe, but suppose you agreed to pay x for the car and the dealer then resold the car for less than you paid, you would , in the absence of contract language to the contrary, be liable to the dealer for the difference between what you agreed to pay and price they sold it at.

No problem, but as mentioned I would let the dealer know now and not wait for it to be delivered.

This is a legal and contractual question, not one to be answered by anonymous strangers on the internet. Don't just assume $500 is the most you would be liable for. And yeah, tell the dealer ASAP.

Actually, I've been down this road. Not with a Corvette but another car. I went to the family lawyer who informed me that I signed a legal contract. The dealer could sue to have me purchase the car. In actual practice it rarely happens, but it can. IMHO, I'd contact an attorney to see if there is a loophole. You might actually get your money back. I did as the lawyer found a delivery clause that the dealer failed to live up to. While the dealer may just let you off the hook and keep the deposit money, be prepared or at least aware they can make it unpleasant.

I ordered my mine about the same time. Yours, like mine, probably didn't get entered in the ordering system until Tuesday March 15th, and wasn't accept by GM until the 18th. Your dealer would still be able to cancel the order if that is the case IMO. I would think worst case is you lose your $500. I ordered mine through a forum dealer and did not sign any legal contract, but did agree to their terms that my deposit is non refundable after the order was accepted by GM, which it was. If you're serious about canceling you should do the decent thing and contact them so they can cancel if possible. Then they won't be stuck with a car they don't want, or perhaps they will modify the order to reflect how they would like it to be optioned.

The dealer I ordered mine from in Oct 14, required only a "Refundable $500. Deposit", and I got friends and family pricing. Read your contract before talking with a $$$Lawyer$$$.

This ! Work with the dealer and they will be more receptive to working with you.

You will be very fortunate if it only costs you $500. Get a lawyer involved to review your contract before you cancel. Good luck. Why the cold feet now?

I agree w. all the posts above that say: 1. act responsibly--go in and talk (not phone, text or email); 2. cancel the deal as soon as possible; 3. read what you signed FIRST before talking; 4. don't assume anything from people who don't know what you did or didn't sign/do.

In many instances, a deposit may be returned (and may even be written as "refundable") even tho you ordered the car and it is being built and/or incoming already. But it depends what you signed and how hard the dealer wants to be if it says, "non-refundable."

They may even want the car just the way your ordered it, but go find out firsthand. And good luck.

You have heard of verbal contracts, haven't you? If you're not a lawyer, and know the OP's state laws, I would have to disagree.

I special ordered a black 2Lt Vette in 2013. Two days before it arrived at the dealer I bought my green 3Lt at another dealer. I called them and said I didn't want the black car. No problem. I lost no deposit and they sold the black car as soon as it arrived. If it is a dealer that sells a fair number of cars, they can sell it. Worse case, you lose your deposit. But honestly, if you ordered what you wanted, can afford it, get it and enjoy it.

I purchased a "ordered" C7 that the buyer backed out of on delivery day. I don't know if it cost HIM anything but it SAVED me a large chunk as the car was on the floor for a number
of months, and the flooring costs were mounting.

No need to make excuses. If you have cold feet, tell them the truth. I think that once you get the car and begin enjoying it, you'll find that you were crazy for even having second thoughts about the car.
