Is there a list of States which will permit Claims for Diminished Value?

First-party diminished value claims (claims against your own company) are allowed in Georgia, Kansas and Washington.
Third-party diminished value claims (claims against the other guy's company) are allowed in every state except Michigan.
Certain states have funky interpretations such as West Virginia which only allows third-party diminished value claims if the vehicles have sustained structural damages. They have buried their heads in the sand if they think that repaired cars without structural damage don't lose value.
You should always check with the insurance department in your state for clarification.
In Texas you have to ask/demand from insurance company. If you don't ask I assure you they will not offer. I truly hate dealing with insurance companies no matter auto or home. It's always a struggle and the treat you like crap. Funny how nice they are when your in the market to buy insurance but you are definitely in for a beating if you file a claim.

I am waiting on a diiminished value claim recovery myself.make sure you get an appraisal from a professional appraiser in order to build your case. The 3rd party insurance co. will initially balk if there isn't structural damage in order to try and get out of paying DMV.You'll also need to file a specific claim.

True this. When my '11 was hit by a semi, I wanted to file for diminished value. The cost of litigation would have exceeded what I would have won.
