I've done a fair amount of heavy truck incidents, and I'm guessing a car accident will be pretty similar. From what you've described you can get info from your vehicle, but based on what you described the info that will help the most would be the info from the other vehicle, since the driver was DUI/DWI, and there was no evidence of any attempt to avoid the collision. A download of the vehicle's ECM will likely show speed at point of impact, steering input, brake application, seatbelt use, airbag deployment, and more. Being that the other driver was charged, you may have an uphill battle getting the car's ECM, but a good Attorney will have ways around that, including obtaining a Court Order to provide that as evidence. The way things work is that basically everybody gets sued, pretty much just because they can, and most times a lot of those are either tossed out or negotiated for settlement. In your situation I would look for a good Attorney specializing in Motor Vehicle accidents, they have more resources and experience in that area. Most times the Judge will assign a percentage of blame and make any monetary awards based on his findings. Good luck on this, but I would certainly use all due diligence in getting a favorable outcome.
