When the car senses aggressive throttle movement it enters performance shift mode and will hold gears thinking you want to play. An associated icon will illuminate on the DIC. The feature is described in the owner's manual.

The feature is mentioned in several placed in the Owner's Manual. Search for the following terms:
Performance Shift
Performance Transmission
Driver Influenced Gear Selection

The description says this happens in any Driver Mode, "however the aggressiveness of the transmission response will increase between Tour, Sport, and Track modes respectively." The setting that actually affects it is the engine/shift setting. So, you are correct that it is affected by your mode selections, but it does happen to some extent in any mode or setting of the engine/shift parameter.

That is what my dealer said as well. Luckily, my trans is good thus far. My problem is I installed headers, bigger throttle body and carbon fiber intake manifold before I knew about the tranny issues. I'm sure they will say those would cause a tranny problem. and Id have to pay 16K out of pocket

My 2023, picked up in Oct of 2022, is within the affected range. I drive 100% in manual mode and paddle shift. I have never experienced any issues from 2-8 gears up or down. However, every once in a blue moon, when the car shifts down to 1st, when at a stop light, it lurches when I go to take off when the light is green. Downshifting to 1st manually was so hit or miss, that I just let the car take over from 2nd to 1st. The lurch has happened maybe once or twice in the last 3 months. I’m on track to hit 7500 miles this Sept and will get the tranny service then. Like others, I’ll just wait for GM to tell me I’m affected for the tranny replacement.

Wouldn’t you have been contacted by now?!?!
I use paddle shifters too however NEVER manually shift all the way down to 1st.

Not necessarily. Remember, this is GM we’re talking about.

My build was among the last of ‘23 in September and no letters to me yet, if it is affected. My 6-month ownership window ended in March and still haven’t received my 500,000 points yet either, so confidence is low regarding timely notification of vehicle defects.
