It seems I am not allowed to upload a picture to use as an avatar. just curious if there is some sort of pre- requisite before I can do this thanks for any help with this, I really just want to use a pic of our vette as my avatar.

You can upload pictures as an avatar but, due to their size, there is rather small limit on the file size allowed. Additionally, you will not be able to use an animated GIF.
Note the restrictions listed in the upload manager for the Avatar:
Anything much larger than that will result in an Upload failed error.
