Is this broken?

I forgot to ask...are your tires hitting on the back side, or the front side, of the wheel well? If my math is correct, I think you might have close to 8" of backspacing with that wheel, which is A) a lot; and B) approximately 2" more than the OE wheels. I'm thinking that your issues might be on the inside.
FWIW, on the Camaro that I used to have, a '96, I had two different sets on aftermarket wheels, over the years. The first set was an "early generation" CCW wheel, 16x9.5, with 6.75" of backspacing. No clearance issues, but I did have a custom panhard bar on the car. The second set was a 17x9.5 Intro wheel, with 7" of backspacing, and again, no clearance issues.

The wheel company was right all along. I took the wheels home and installed them myself. When it is jacked up by the axle there is plenty of clearance. I think the look awesome!
