Thank goodness for the PDR
Was hit yesterday. As I am passing a car they came into my lane. They said that they did not know how I was there as they thought they were in the far right lane. Uploaded the video to both my insurance company (who has already came back and said that they are at fault) as well as the other persons insurance company. Allstate wants 7-10 days to determine.

YES, it is legal to pass on the right. The second or third lane to the right only needs to be marked or lined as a separate lane.
