I received a speeding in gilbert, of 49 mph in a 25 mph construction zone. A criminal violation. Do they let you take a class to avoid the points. They said I have to ask the judge for permission. Just looking to see what your experiences have been. I have not had a ticket in 3.5 or so years.
They may give you driving school, that will help with the points, but since you were in a construction zone, the fines are double and the jusge may take your actual speed into consideration also... Doesn't look good for you, but ya never know. They've let murderers loose
It's been alot of years since I wrote tickets and they didn't have the construction zone law then. I believe the fine is only doubled if construction workers are present. That will probably have a big effect on the judge's decision too. I'd check the normal (non construction zone) speed limit and admit guilt but qualify it with what the normal limit is. If there were workers present I'd just claim stupidity....oh wait, I mean ask for pity from the court.
The first thing you need to do is approach the prosecutor and ask for traffic school. Tell him you'll pay a normal fine/fee for the school. They have a huge number of cases and "normally" will deal any they think they can get rid of. If he isn't cooperative then through yourself on the mercy of the court.

OUCH! I know two people with recent cases of criminal speeding. In one, my best friend was driving with his head up his azz in Scottsdale doing like 50-55 in a 25 zone. He was pulled over, got a criminal violation and was told school was not an option with that type of ticket. The prosecutor also said no to school. He had to appear before the judge, and when he did he admitted his mistake with sincere regret and the judge did allow him to go to school to dismiss the ticket, BUT ONLY ONCE!
The other case involves Kameron leaving Firebird trailing us on the way to the Gila Bend BBQ. He was doing what, 90+? trying to catch up with us in his Monte Carlo. The cop heard Glenn and saw Kameron, at least that was the theory, and Kameron got nailed. In Kameron's case the judge did not allow him to go to traffic school, even though Kameron says he did ask.
Definitely ask the prosecutor for school, but I have a feeling it's going to come down to the judge, so think about how you're going to ask him/her for that option.
I can't tell you the laws on the Construction Zone, but I have been 30+ over the Speed limit and got to take a class and have no points put on my license.
I did have to go to court though. The judge thankfully listened to what I had to say and I got lucky with a nice judge.

Well I had my court date. There were 30 others caught in this same trap. We all were allowed to choose driving school, unless there were extenuating circumstances like a few of them had; no license, dui, on probation. Whew !!!

Wow Like Eddie said - 30 drivers in the same speed trap. I guess crime's taken a vacation in the thriving metropolis of Gilbert!
When I hear stuff like this it kinda pzzes me off - and makes me wonder if enforcing traffic laws is for the safety and welfare of the public or is a revenue generator.
I would contact one of the local TV stations and tell them the story. Traffic school is an F'n joke that pays the municipality over a $100 and you get the privilige of wasting 8 hours sitting listening to some retired LEO pretend he's a comedian, or worse, a retired LEO who forgot he's retired talk down to you like you're a bunch of 3rd graders. For your time and trouble, you get out of a ticket with no points. Find out if you can take the traffic school online - it's starting to be offered in some parts of the country.
Gilbert Police are the worst...... Zero Tolerance Zero warning and they hide all over the construction zones which needless to say are EVERYWHERE in Gilbert as the whole town is under construction, most people I know just avoid it You can be coasting going with the flow of traffic and still get pulled over "I Know"!!
