I recently sold a set of tops to a guy on ebay for a very minimal price, ($150 +$55 shipping) and I specified with pics that they were M1131 mirrored glass tops off my pace car, the drivers side was cracked (arent they always) I never specified that they were blue, bronze or black, at the time I didnt know there was a difference in them, hence the reason I put the part number on the listing. During the numerous emails back and forth, he never asks about the color, just the M1131. He buys them, wants me to sit on them for a month while he finds a builder. Finally sends me an email specifying that he talked to Ecklers and puts the M1131 in the email where he talked to them. Ecklers said they would rebuild them. I ship them to Ecklers and they call the guy and say they wont rebuild the M1131. The shipping ($127) ate all the profit up because I overpackaged them wanting to make sure they got there in good shape. He's pissed, makes a reference to my color blindness and wants me to reimburse him another hundred bucks. Which means he not only get my tops but puts me in the hole on this deal. If he hadnt made the color blind remark I would probably have had him ship them back. Since the M1131 is rare, I figure I could resell it. But since he did make the remark, I'm kinda pissed. I did send him the name of another builder who does M1131s. Am I wrong? I wasnt trying to screw anybody, but I get my back up in the air when personal remarks are made. Whats ya'lls opinion on this?
whew......... I dont understand the "eating up the profits" thing but thats beside the point.
You sold the gentelmen p/n M1131 with no color indicated.
You held the merchandise for an additional month with no additional storage charges imposed onto your customer.
You have a document that says Ecklers would rebuild them.
For whatever reason you shipped them to Ecklers instead of your customer. Hopefully you have a document that gives you instruction to send them to Ecklers.
Ecklers then says they cant rebuild these particular units. Hopefully also you do not have a disclaimer from Ecklers that indicates a rebuild is dependent upon a prior inspection.
If the stars are aligned properly the burden of responsibility for receipt and possesion now lies between Ecklers and your customer.
You gave full disclosure and followed instruction on where to ship them.
I think your out of it.
good luck

really wasnt any profit in it, was basically a test to see how ebay sales worked. I have the emails from him directing me to send them to Ecklers and he gave the job order # for them to rebuild M1131 top. He scanned the job order and sent it to me to print and enclose in the box and he specified M1131.

Forget him. He's mad and not gonna get better. Let him leave bad feedback and just explain what happened in your response.
Next time put. "Parts as is, no returns, please ask questions before bidding".
If you have his mailing address I would send him a registered letter outlining all that has transpired stating again that full disclosure was provided by yourself and shipping instructions were provided by him and that if he prefers to go to litigation all future correspondence should be by certified mail within the next 30 days.
The last statement is a definant stance on your position and the enevitable next step is litigation. If you dont hear from him within 30 days its over.
or//You can be a really nice guy and take the loss. Personnaly I would send the letter. His off side comment about you beng color blind is his attempt to shift the burden of responsibility back on you.
As explianed to me by a lawyer a registered letter is the best form of receipt because he has to sign for it otherwise the postal department is responsible for proving receipt. Anyone can really respond to an email if its left on as there is no signature involved.
If ebay makes a stink about it and your standing with them send them a copy to so they will be aware of the business practices of this customer.
He doesn't have a leg to stand on, especially if you had pictures in the ebay ad. Ignore him. It's getting very common for buyers to hold you up for positive feedback. Feedback blackmail. Do a search on Ebay. It's just getting to not be worth the trouble to sell anything over there anymore.
And, yes, I always put the disclaimer, as Merlin suggest.
thanks for the input. I am still awaiting his response, he hasnt left any feedback on ebay yet. I was an ebay virgin on this sale, so I didnt have all the disclaimers in there. I learned a lot from this one.
You should still be fine. All he can do is go to Ebay and Paypal (if he used them) and ask for a review. You sent him what you sold him. Of course, he'll probably leave feedback at the last second so you won't be able to respond. Don't sweat it. Like getting the first scratch on a new car. Don't let them make you feel like the bad guy. He's trying to screw you, not the other way around.
I have several other items I was going to sell. I have been reading all the disclaimers, now my ad is going to look like all the fine print in a credit card agreement!
I have bought tons of stuff off ebay for my vette. Havent had a problem, cause I asked questions from the seller or I had done the research on the part number.
Just the way this guy phrased the color blindness thing with the "you need to deposit 100 dollars in my paypal account" set me off. Kind of made me feel he was trying to scam me.

Tell the guy you sent exactly what you said it was & you are going to going to EBAY'S dispute site to register a complaint. He is trying to hold you up. My guess is that when he was told they wouldn't rebuild them he wanted to bail.
KEN
you are done with this guy, dont give it much more thought. he may give you negative feedback, but you can do the same thing to him also.
don't reimburse him a penny.
The unfortunate thing about feedback is that if a guy has 100 transactions and 10 neg feedbacks. I will probably still buy from him if I want what he has. I will also sell to him if he pays up front..
Someone who responds with the type of response he has given you so far can be seen through in their feedback. I have read negative feedbacks and saw through it and made my purchase anyway. Give it good thought when you repost to him. Short and sweet. Those few words can "show the light" of the true intentions. If he has any negatives similar to his color blind comment ...it will show he's an A$$
If you've ever sold anything you know that there are just some people who you just can't please no matter what you do!
This guy sounds like someone who is so used to screwing people. He has the nerve to demand that YOU give HIM $100 on top of the parts he already got! Sounds to me that even if you had given those parts to him for free, he would have wanted you to send him $$$ for a new paint job so his freaking car matched the parts!
Its sad that there are people like that but trust me, you can't do anything to make someone like that happy. Life is too short for such petty crap and people like him feed on making people like you try to make them happy. Its a never ending circle, just forget that Richard Head!

Guy emailed me back, apologized about the remark, said he didnt mean it that way.... wanted to know if I knew of any other shops he could use to get them rebuilt, I gave him a couple of more and pretty much ended it right there. Today I checked my ebay feedback and he left me positive feedback.
go figure...?
