The road was curved, thats why I slipped sideways. The curve is right next to a dirt road where dump trucks come out of all the time. The winter sand was still on the road too, which they just cleaned up today. Maybe I should see if I could get a DPW record of them cleaning the road the day after my ticket for sliding on sand? :D
Now your thinking.. I've found that if you go into court with a possitive, not grobbling attitude you get further. I like listening to other defendents present their cases to the judge. Watch the judges face. They can tell by the way people are telling their story if they are telling the truith or just trying to snow the court. If you go in with a work order or even a note from the DPW saying there was excessive sand on the road you'll get the ticket thrown out. And even if the DPW doesn't give you a copy of the work order or a note you tell the judge that you went to the DPW to get it but their policy is not to or whatever reason the DPW gives you as to why they wouldn't give you a copy. I think they will cause it's public documents. It shows you really feel you were not wrong and you tried to prove it in a reasonable way. You did some extra work other than just saying you didn't do it.. Possitive, concise, matter of fact, (with some proof.. :) wins every time. :cheers:
If the road was curved, you may have a case. Pictures always help too. Get a picture of the curve, and a picture of the dirt road enterance as it relates to where you fishtailed. If there are a lot of dump trucks coming out of it, there will probably be more dirt and sand on the road before your case is heard, but a work order from the DPW won't hurt either. The fact that they cleaned it up illustrates that it was a road hazard. If it wasn't a hazard, they would have left it there for the rain to wash away.
