Hi all, Been a while since I posted-been driving the vett and working on my other project. Question time, I was sitting in my vette in a parking lot, waiting for traffic to clear-a car had backed out of a parking spot and had blocked all traffic-and another car backed into me!! I as not moving, I was sitting in my car, and she refuses to file a claim with her insurance company!! She wants me to file with my company and expects the claim to be settled 50-50 and she backed into ME!!! Any advice appreciated. Dave :confused: :confused: :confused:
Unfortunatly if this was in a parking lot you may be out of luck. In most states, not for sure in Mn, in a prking lot makes it an automatic Civil matter that the police won't pass a judgment on. I would check with the police just in case, but you may have to take that corvette wrecking bi@#h to small claims if she refuses. By the way what kind of damage to the vette? :mad
Insurance is pretty cut throat. Call your agent. They will go after the others company. That's how they work. The next time it might be reversed for the two companies. Just don't wait, hurry!
I had a similar incident years ago. A guy side swiped me in traffic. I was not moving. He would not report it to his insurance. After a couple of weeks of him putting me off I called his insurance. They new nothing of the accident till I reported it to them. I sent them a copy of the police report and they then sent out an adjuster and paid me for damages.
I hope you have her insurance info. Call them yourself and report it. Go from there. Even though it is private property I would hope the cops would at least make out a report for you to take to the insurance.
Amost the same thing happened to my wife with the Jeep in a grocery store lot. The other woman refused to give any info other than her name. My wife drove to the police station and filed a report, came home and called the insurance company. They took care of it all.
Outcome: The other woman was charged with "refusing to provide proof of insurance" in a non-injury accident. It did not matter that it was in a parking lot, or that she thought damage was not done to our car, or no one was injured. According to the police she MUST exchange truthful information even if both parties agree not to call the police.
Siince no damage (those high Jeep bumpers are great) was done to our car the insurance company just made sure that no claim was filed against them by the other party.
My Motto: Always file a police report and always notify your insurance. Let them handle it - H*LL that's what we pay them for!
Thanks for all the input-it all helps. After the accident, $800 damage to the vette-she T-boned the door-she was very sorry, etc. She made the call and the cops arrived eventually. The accident happened in North Dakota and they do not file accident reports!!! Something about the budget! All they did was verify that we had exchanged names, insurance info and such, placed a sticker on my car to show they had been there and left! Apparently the lady got some "cheap" legal advice and decided to drag her feet. I had called my insurance immediately after the accident and called again today to explain. They filed a claim against my policy so they can go after her company. Unfortunately, even tho it was clearly her fault, it puts a mark on my record and in todays market, that's all they need for an excuse to raise my rates!! :mad :mad Dave
