He bid on a customized/modified car, it is obvious from the pictures & description. You state what the head numbers are at the bottom of your auction.
I do believe he is looking for a way out of the auction... buyer's remorse... you are in the clear because everything is stated up front... it was his responsibility to research before bidding.
My NCRS judging manual says they are for a 69 390 or 400hp, but where used on 68 cars as early as March of 1968.

Saying the car is only worth 5000 with those heads. Yea right. I have tried to contact the second bidder, but no response. Maybe I will just send second bidder the second chance offer and see what happens.
I will pass this info on to the high bidder though.

It looks to me like you left him an "out", but it should cost him:
If, when you come to get the car you feel the car was misrepresented I will refund half of your deposit. Consider the other half a looking fee.
It sounds like he "feels" the car was misrepresented, so he owes you $375 and you keep the car.
Personally, I don't believe you misrepresented the car as "matching numbers" usually means engine block, especially when you specifically state that you don't know about the tranny.

I told him that too. He said he wanted to pay the listing fee instead. Now that Blackknight hooked me up with the info, there is no way he can get out of it. The car will not be judged by a corvette black book to be NCRS certified.
If he still tries to get out of it I will do all I can on the Ebay side of it.
The car is what I said it was PERIOD. That was his big hangup...the heads were not right. I emailed him and told him he got a good deal after all!
I purchased a 81 vette with 41k on the ad from ebay. The seller even took pictures of the speedo on the ad. when I got it shipped home- it looked like It had alot more miles on it. I did a car fax and found it had 132k miles 5 years before at a registration in texas. I went to a lawyer- he says you are right- but to sue someone in another state will cost you 20k and your not sure you can win- so best to just inspect the next car and learn your lesson. I fixed the vette and sold it. and made 2k
