title problem

Default title problem

let start by telling you I got the car from ebay. (Item number: 4527963279) first mistake. I live in tn and bought the car out of tx.
Well when I arrived to pick car up. after 725 miles to find out that the left head light assemble is gone. and that the coolent fans don't work. Not to top it off the person on the title was in jail over drug and she used white out on the the title. Well I thought maybe it was a good deal. So I trailered the car home. Now with the title in hand and a suppose affidavit saying that the white out was a mistake. Well went to get car plated here and they won't accept the title, they said I need to contact her and have her get me a new title. Well she is in jail and don't have a way to contact her. The person picked car up from told us that she was move to a different jail and don't now where. Well call the dmv in tx and got a run around that they don't give affidavit's to any one. That they need to see the car in person and the title to straighting it out. What do you think I should do. I can't take time off to go back there and try to straighting it out. I did a car fax and had the vin checked and all seem to be fine. Any ideas

Wow! That is definetely a unique set of circumstances. I have heard mostly good things about buying cars on Ebay. I would recommend that you get the title straightened out at all costs. If you don't, there will be no way to plate the car, transfer the title or sell it in the future. Try to contact the State of Texas Secretary of State office and explain what has happened.

Wow that sux

Seems like a great price, but not for that kind of hassle - maybe try it at some other DMV offices in your area? Better than dragging it back to TX, and maybe someone at another location won't be such a hard@ss about it...

Also, real slick of them cutting off the LF corner in that pic on the auction - GRRR

I can't believe that someone would take a picture at that angle and NOT show that the other headlight was completely missing. I would have been really upset - they didn't even mention it.

I got the head light assembly. And just waiting to get title straighten out before its painted. Haven't decided on color yet. I want it very bright and to be a head turner to even them old lady's that are 80. This is my first vette and want it to be done right. I have been looking at alot of different ground effects and wing for it. just have to decide. will post pics when done.

I believe because you were defrauded (at least that's what I would call it), if you wish, you can be reimbursed by ebay's own policy. If you decide that you do not want the car, contact the proper department in ebay and explain the entire situation. Taking the picture at that angle to hide the missing headlight was obviously done on purpose and a case of intent to defraud could be made. Looking at a picture that does not reveal the entire car, or written another way, looking at a picture that hides part of the car, would have or should have been an immediate tip that something was amiss.

The asking price (with no reserve) being as low as it was, to me, was a red flag indicating that something might be wrong. I believe you were deceived, duped, defrauded, mislead, whatever you want to call it. And this car will probably give you nothing but problems. If this happened to me, I would try to quickly get all my money back. Putting white-out on a title is a big No-No. I would have been extremely surprised if it had been accepted.

If you want a refund, do yourself a favor and immediately make the effort to extricate yourself from this quagmire before it becomes impossible to obtain a refund.

I have made a claim with ebay under the vehicle purchase protection. I have not heard back from them. I just got a paper from tx today in the mail. I need to fill out these papers and send the title to them to see what they can do. I will know next week. The car seems to run and drives fine.

And signatures on the title have to be notarized so if the seller can't be found you may still have a problem unless BMV Texas has a way to help you but I would not hold my breath. Good Luck getting it straight keep us posted as this is a unique thread to say the least and BUYER BEWARE

Do not be suprised if ATF shows up and confiscates the vehicle if the previous owner was associated with drugs. Then you will have no car and no money, they, ATF, will just haul it away and leave you standing wide mouthed.

x 1000 ... Might want to hide it for a while, at least to get some facts straight. 1Patriot is right, they get wind of a car they can snag, and thats more money for them when they auction it off. They might even get a big chuckle out of snaken' it from you, since you have no valid title in your name for it. Might want to part it out, make your money back at least, then let them haul it away. Consider selling a MAF off of it ?

As of right now i have the paper work to get a bonded title. I will sending it out in the mail tomorrow. I should hear something on it in a week. Pretty bad that my first vette,I had to go threw all this to get it legal and still got to wonder if I will ever get it straighting out. We will see in the next week or so. I keep you posted.

I, like you, bought my first vette on eBay and had problems with the title. There wasn't any fraudulent activity going on. Just people trying to not spend money to get the thing up to date. I picked the car up in November about a week after the auction completed, and finally got an Oklahoma title in late January of this year. Luckily, the seller came through and ponied up the $575 to get the title straightened out in California. But only after trying everyway to keep from spending the money.
My suggestion to you would be to file for lost title. There will be certain procedures you will have to follow. Contact your state DMV and they will tell you what to do. I think it will be cheaper for you in the long run.

It's pretty standard to apply for lost title and doesn't cost much, that should straighten everything out for you if what you're trying now falls through for any reason.

Honestly you got a smokin deal on the car Who cares who the previous owner was and how bogus they were (no offense bogus). Just be prepared to go through the car and do prevenative maintenance from bumper to bumper ie: fluids, filters, etc.

by the way what's wrong with the paint? it looks good in the picture?

Default I bet you can bond the title

Most states have a method of clearing up a troubled title. You will have to purchase a bond after you send inquiries to the previous state(s) of registration. You need to have it inspected, pay a nominal fee for a stolen car check, and formally claim ownership and show any supporting docs like bill of sale etc. After a period of time (three years usually), the title is issued as any ordinary title with no mention of bond. You are able to sell it with a bonded title but the quality of the ownership is still theoretically in question while the bond is in force, so it might be less desireable and therefore worth less.
I had to do the same thing here in AZ for the same reason (flaky ebay seller). Told me the title was 'clear and in hand'.....so I sent someone 600 miles to pick up the car and after he gets the cash put away in his pocket, he says 'I'll have to find the title, it's not here"...... (and apparently it never was). And the car was massively misrepped to boot.....
Advice: get the clean title signed BEFORE you hand over any bucks. If a deposit is required, get a notarized copy of the docs that will be signed over before you send a deposit. Examine the docs closely, ask questions, and be particular.
If the seller doesn't want to do any of that, you can probably count on some kind of trouble. Asking for proof of clear title and ownership is not asking too much. There are plenty of other deals out there to chase around.

I have made a copy of every peice of paper work, even the ebay auction. I really like the car. I have changed the oil and plugs. But now I'm afraid to do any more work on it until I get the title. I wanted to order ground effect and wing but an holding off till I get a title. I really wanted a vette and looked fo 5 months to find a deal. I was hoping to have the paint and ground effects and wing all done by the begining of april, so I could enjoy the car all summer. Thanks for all the help. I will keep you all posted on any news.
