Default Court date

Well, today is court day for the damage the transporter inflicted to the Vette! At 1:30 we'll see what happens with the idiot. I don't really look for him to show up but if he does it doesn't matter much as it's a simple abailment case. I haven't disclosed the name of the guy yet but I will PM it to anyone who needs a transporter upon request so you know who not to use. I've found out through invetigating the guy that he was (I don't know if he still is or not) operating unlawfully by not even being registered with the U.S. DOT. OH, by the way, I can't wait to see Judge Mays do this......

Hopefully you are dealing with insurance and not the man directly. Because
A judgment is about worthless unless they have a lot of equity. Ive personally have 2 judgments out on two people right now for $1400 and $2900. The oldest is 4 years old now and ive yet to see one single penny. And yet both are car lot owners that are still in business today.
All you can hope for is they win the lotto, get a large inheritance or become a person and pay their debit.
Basically All I did was pay $250 each person to hurt their credit.

Now I get a mechanic lien on non payment customers. It gives them 30 days to pay up or I keep the car. Although they suck too. You allowed to take the car as payment but you can never get a title. And if money is owed on the car you can get sued by the bank if you sell it. Even if the mechanic lien is 100% approved.

Dont be so quick to assume you won this already.Several years ago one of my cars got smacked by a public bus.The blind moron driving the bus pulled out of a bus stop and nailed my car at a stop light. My insurance company were dragging their feet takin care of this so I took the bus company to court. My case was dismissed on a technicality,I didnt file a tort claim with the bus company. The bus company never informed me of a tort claim so how was I supposed to know what one was.Had I hired a lawyer for advice on how to deal with it I would have won my case. The final out come, after my insurance company,A.M.I.G. gave me some bogus info I threatened to file a complaint with the Ca Dept of INS.They paid for the full amount of the damage. The bus company got out of paying anything because my insurance company was too chickin $hit to go after them. A.M.I.G sucks.

There is a difference between a lien and a Judgement. To some extent you are correct as what is allowed varries from state to state. In Illinois however, the next paragraph applies.

The guy's got a new 2010 Ford F-350 Crew Cab Dulie Diesel and IL law allows for the taking of any asset(s) to act as security against the judgement. He's bold enough to post his schedule for week to week ahead so the case cures for 30 days we send notice to the Sheriff's Department where he's headed and they sieze the vehicle for rendereing to the plantiff (me) of the complaint.

We have filed a Tort claim and have a contract case also. The real meat and potatoes is in the criminal complaint we are preparing to file for "Theft over $300" for the parts he removed form the car without my consent or knowledge which is a felony in Illinois. This is before we get to the misrepresentation on his part in terms of insurance claims and the registration claims on his part. The guy is NOT registered with the U.S. DOT and therefore cannot transport cars across a state line or lines for money. I was unaware of these facts when I contracted him for the transport. Perhaps the first sign something was not right was when he called me at 2:30 AM to inform me he would be at my house at 3:00 AM. Remember "Midnight Auto Parts"?

Thanks Dogfish. One correction though, we haven't had a "justice" system for a long time, what we have is a legal system.

Entirely too well Steve, what's I think is the worst part is this guy is still out there doing the transporting and hopefully he will learn something in this process too.
