"NO, we don't give those out." so then he writes me a ticket for basically everything he possibly can, including $130 for my windows being too dark!! what a JERK! I told him I was going to fight the ticket, and I am - I'm going to DEMAND to see the radar slip, and it's BS that they aren't allowed to give them out cuz a buddy of mine got stopped not long ago and the cop offered it to him. So if he shows me the slip in court, it will be either fake or someone else's slip, at which point he'll be dirty for lying. Under "comments" on the ticket, he wrote "radar detector"!!!!

There was absolutely NO way the cop could have radar'd me since he couldn't even have seen my car, I was over a hill, much less hit me with the gun. No, he fudged the papers and is dirty. I hope he's happy with himself. If he caught me legitimately, why so angry?
Kurt, I have nothing to offer you as far as advice, but I do have an opinion. Please do not mis-construe what I'm about to say or interpret my comments as being a "Cop-Lover", "old fart who always defends cops", or any of the other things we've seen here...this is just my opinion, okay?

Right or wrong, the LEO has the final decision about whether you're getting a ticket or not. What happens in court, most of them couldn't care less. He accomplished his mission, and that is to get you slowed down or stopped. If he's determined to be an A$$hole, you don't make the situation any better by being an A$$hole back to him. This is not a game to see who can be a bigger A$$hole - the rules in this game favor the LEO.

If you offered an apology or even a polite comment, you stand a chance of getting a pass. Instead, by getting pi$$ed off - you got busted for 76 in a 60 and another $130 citation for your tint. If this continued to escalate, I'm sure he could have written you for more violations.

I know it can be painful to smile when your getting your A$$ handed to you, whether it's legit or not. But being polite can never make the situation worse.

I'm not defending the LEO's actions, I wasn't there, and I have only your account of what occurred. But unless you are planning to go to court with an attorney - your stated plan is only going to net more for you to wade through.

Again my opinion - sorry you got busted and I hope it all works out for you.

I used to get pulled over all the time for being young and in a fast car but doing nothing wrong. I feel your pain. Now I'm bald and in my 40s and the Leos don't even look at the old fart in the yellow vert.

Well....You did admit that you were doing 80 in 60. And being that you have the radar detector....I bet this wasn't the first time you have drove over the speed limit. It's like the saying goes...."When you go fishing you can't always catch all the fish in the sea".

You did say you were going 20 over the limit. So in theory, ya gotta admit you did deserve a ticket. If you're not willing to get a ticket, don't go over the limit.

Being responsible includes accepting the fact that you are going to pay for your misdeeds sooner or later. In your case, sooner. I know that sux, but that's life in the fast lane.

Every time I take Red Racer for a bit of exercise, I realize that I may get caught. And I'm prepared to accept the consequences if I do. I don't expect them to let me off or warn me. Nice if they do, but if I break the law I have to pay for it. No excuses.

TOTAL ******T fight it what have you got to lose you already have the ticket the worst that will happen is youll pay full price, they write radar detector on the ticket so when you go to court it makes you look like a habitual speeder and will be guilty, you must convince the judge that you have the radar detector to let you know your in range because of the car you drive your always profiled, chances are he won't be in court as long as your straight forward and convincing you should be able to beat it,in the last two years I have beat three speeding tickets we drive very high profile cars, good luck.

And that's such old, worn out phrase and it smacks of being an A-hole.

Should he get a ticket for speeding last week too?

My brother-in-law was a LEO for 25 years and he was one of the good
guys. But every once in a while he would tell a story where he would
answer notorist with BS lines like that.

I asked him, "Rich...Do you really say things like that to someone
you stop?" He says, "Yeah...Depends on the situation."

"And you wonder why poeple don't like cops sometimes?"

On the top of his ticket book were the printed words.
"Be courteous...Do not lecture the motorist."

He retired because he couldn't stand the newbies coming on the force
with the power trip attitudes. He just wasn't one of them.

Watch out, get ready to duck: here comes another "old fart" piece of advise: you absolutely won't get a ticket if you obey the posted limits. I've gotten lots of speeding tickets in my past, and I bitched about every one.I can honestly tell you that I deserved every one as well.

Have I "exceeded the limit" in my C5: YES absolutely. Do I have a radar detector: no way. Your chances of "nicing" your way out of a ticket go down to ZERO if you have a $500 detector!

As an aside: LEOs will frequently look for any little thing to pull you over if they want to do a "random search" for anything suspicious. Down here in TX, thats how they get all the runners and smugglers going up I-35! If they don't see anything funny, they just move on!

I am a lawyer in NC. What I can tell you, is that there are no guarantees. You may spend money on a lawyer and a ticket.

Well, cops can't pull you over and do a "random search";however, than can pull you over for any little thing. The United States Supreme Court specifically allowed pretextual traffic stops in Wren v. Can't remember the whole name. If they "see" you cross the center line, tail light out, etc...they can make a stop, even if the real suspicion is DWI, drugs, etc...

Still, to search they need probable cause and not just suspicion. Further, the court has recognized that a person's reasonable expectation of privacy is somewhat reduced in a motor vehicle. This is true for a variety of reasons, including the fact that vehicles and the items in them are mobile. The applicable Supreme Court case is Carrol or something similar. The requirements for a search are less stringent in a vehicle and a warrant is not always necessary. Please note, that this is a simplified version of the law...but "random searches" are certainly not allowed.

I agree if the driver had the attitude first, but it seems like the police officer is the one that came on strong from the start.......then again, we're only getting half of the story.....

I never give them attitude, but I've gotten some from them for no reason.

But I've witnessed way to often police officers giving me the impression that they can do whatever they want and get away with it, whether it's harrassment or just flicking on there lights cause they don't feel like waiting at a stop light and then turning them right back off once they get through the intersection (no emergency, I see them do it many times). I still believe there's a few good one's out there, but only a few.

After reading the post again I still believe Mr Cobain is the one with the attitude! The officer refered to him as sir and stated he would not debate the issue which clearly shows who had the attitude, Remember you are only getting one side of the issue, The officer did as he was trained,not to get into a verbal confrontation!
