Last info from lawyer was DO NOT cash the refund check. He feels that it usually hard to get to one of these waranty companies, but loofeels good in thois case due to the inspection report and their admission that they made a mistake. However that admission was made when they called me and I bet it was not on a recordewd line. We'll see what tomarrow brings.

WD tried the hard sell on me when I was looking for an extended warranty. This drove me over to Dennis @ Fichtner for my GMPP. Have yet to use, but peace of mind has a value.
yep..if they knew the car was modded and sold you a warranty they are azzholes...
I almost bought an extended warranty and they offered a payment plan..basically pay like 8 mos instead of all of it upfront...what they failed to tell me until AFTER they sold me was that I had NO COVERAGE until they were paid in full...so basically the first 8 mos were usueless....I demanded and got a refund of my downpayment...fuggers
Thanks for this CRUTIAL information. I am looking at getting a warranty also (shopping, though). The company is Smart Auto Warranty. I'm opting for the payment plan. BUT if the coverage is not effective until it's paid out, this is not GOOD.
Warrany Direct won't covered cars with modifications
I purchased extended warranties for several cars, including my Corvette while all were still under factory warranties. One of the cars already had an intake system and cat back system. I was planning to do the same to the others. I called Warranty Direct to see if this was going to be a problem. The representative's response that any vehicle that was not stock would not be covered, even if the repairs were not caused by the aftermarket equipment. I asked if using non Delco oil filters on the Corvette would violate their requirements. His response was that anything that differed from the car as it came off the assembly line would affect coverage. While I don't believe a non Delco oil filter would affect coverage it would appear that Warranty Direct takes a dim view on modifications of any sort. I cancelled the policies and received refunds. I still would like to purchase extended warranties, but I need to be sure that minor modifications would not affect coverage, assuming of course that the needed repairs would not a direct result of the modifications. Any suggestions? How about GMPP?
I still have factory warranties in effect on all the vehicles.
In reading the warranty WD states any modification, but does not define a modification so they always have an out. Once a policy is issued it is up to the repair shop to inform them of any modifications.
Nothing more than legalized pickpocketing (<not a real word). Do a google search on virtually ANY warranty company, even a corporation backed warranty such as GM, Acura, etc.. It's simple. They send the inspector out to see your car with one set of instructions: make the owner at fault any way possible, and if they absolutely have to pay for it - cut as many corners as possible. Prepare yourself to pay for the repairs.

Any and all warranty companies will look for an out. The M.M. act says they aren't supposed to, but again, they will try. They have more time and money than any of us. My guess would be that insurance adjusters of many kinds get a bonus or kickback for paying under the standard amount per quarter. I know a few of their salespeople that have many Hawaii trips between them. Why wouldn't their adjusters get the same treatment for keeping more money in house?

I assume your attorney feels that an aleatory contract existed and the "FOUR CORNERS" doctrine should apply in light of the inspection report. It would appear that WD lacks the "good Faith" to perform under your contract. If it comes to it, I would think any decision goes your way. Hopefully, there isn't one of those arbitration clauses in there that will screw things up; I believe companies use these unfairly to gain an advantage to screw their customers. I also fear that WD uses these tatics to "wear you down" so your remedy cost more than the actual damages. As a consumer, these are valuable things to learn about a company so you can make an informed decision when deceiding if you want to give them your business (or not). PLEASE keep us informed as to your progress, There are a lot of Corvettes that have been doing business with them up to now.
To date, I have read this thread with much interest. I have been getting quotes from WD for extended coverage on my vette. After reading this thread, I have decided to not pursue WD. So whether they are at fault or not, they have lost a potential customer. Hopefully, others will proceed with caution with WD. Hope you win!
Attorney to send second stronger letter this Friday if I haven't heard from them them. Then it's a question of what we file in the court system and where.
