That's a good question. Yes, there would be a statute and I would have to look this information up for you when I'm in my office at work. It would depend on the state. I would also suggest you contact your adjuster and request something in writing to document their policy/procedure regarding diminished value claims. You can also have them document the specific statute.

Carfax is only as accurate as the people that report to it. Since you're having a dealer do the work, they may well in fact report it, whereas, an independent body shop may not.
I've never heard of full disclosure laws pertaining to vehicles, real estate yes, but cars?.
Were it me, if the potential buyer doesn't ask, then I damn sure wouldn't tell.
