To the OP. I would go for a new engine or to take the car back. Don't settle for a used engine. You could end up with a lot more problems with more people then just the dealer if the shop installs incorrectly or the used engine is bad. Plus the mileage won't match up then when you try and sell the car everyone is going to wonder why there is a used motor is a 9400 mile vehicle.

And to the OP: if you keep this car, I don't care what is done to do it, you need your head examined. Return it for a full refund and run far and fast in the opposite direction.

Don't be nice. The dealer was trying to take you, and would've done so had it not been for your mechanic. Let your lawyer handle all the communication, and if the dealer won't be nice, then take 'em for all they got.
This dealer needs to go down. Think of what they're doing to others. It may be widespread and you've got the opportunity to get the car you REALLY want and stop the fraud.

I signed a retainer with lawyer who is taking the case on contingency. He believes I have a very good case after reviewing the documents. We have named the last two owners in the suit. I have documentation that shows both of them tried to commit fraud to increase the value of the car and violated CA emissions laws. Also, both of the dealers are pointing at each other.
It is clear to me that these dealers think "As Is" covers them for any car they sell. Actually, "As Is" statements are worthless if you know something is wrong with a vehicle you are selling (and someone gets a hold of the documentation). Also, I found that the people who don't want to talk you, sometimes, tell you the most!
It is not an investment, and if it drives great, is it really worth legal action?
The Legal action fees and time may wind up costing you more then buying and installing a new LS6 or LS2 Create motor.

RamMan, thanks for the dealer work check.
Courtesy Chevrolet recieved the car on trade-in August 2007. (My theory, with some info to back it up) Shortly after that they discovered the car had an 98 LS1, decided they could not sell it in CA, so they shipped it to AZ on a trailer to sell.
I don't think the guy who traded it in blew the motor; I see a number of z06s at the track that take the abuse just fine. I know of a couple people on this list that keep-up with or pass the Porsche GT3s in their z06s. I am sure he thought he was real clever when he swapped the motor.
The car seems powerful with the LS1. It may have a cam in it. It has dual valve springs (I removed the valve covers to check). I need to have it dyno tuned. The intake had a massive leak and the long term trim was maxed out. I fixed the leak but have not driven it to get the computer to re-adjust.
