Ok...so about a month or so ago I had about an 8 inch scratch repaired right in front of the passenger side rear wheel. The scratch was deep as I had caught a concrete turnstile at the bank drive thru. Anyway, a few days ago I noticed that about an inch of the scratch was again visible so I went back to the repair shop and was told that something obviously had struck the car and that this was new damage. I said that it was exactly the same scratch and that they should repair it at no charge. I got nowhere, so I am going to speak to the owner on Monday.
Any thoughts on how I can prove this was not new damage?

The chances that new damage happened in exactly the same spot are very slim IMO. If you have pics of the original scratch, that would help. Otherwise, you may just have to rely on the owner to come through for you. Good luck.
I find it hard that you would not have noticed it in the first place. I know I would have carefully looked at it down the side to see that they did a good job, and if it looked like a good job I doubt they would miss a 1 inch section. I doubt that there was anything that would shrink in a scratch repair, unless they did a really crappy job and just filled it in, smoothed it out and painted it. Does it look like the paint has cracked open or a real scratch?

It does look cracked open...it is part of the original scratch in my opinion....
If it looks cracked open, and they had definately painted it, then I think they need to fix it and correct their bad job. Good luck. Let us know how this plays out.
What did they touchup, colorcoat. clear BOTH? A lot of the "touchup" paint is not the same paint the factory uses-the colors can get close but they weather different, especially lacquers. The scratch repair can shrink and show through the repair, crack repair can be even more visible over time as the repair materials shrink.
