Default Grounds for a law suit?

I am the original owner of my 2001 Coupe. Over the past 9+ years, I have spent about $200-300 in maintenance paid to dealers (I had the fuel filter replaced, plus LOF). Well, let me clarify ... I *do* have to pay for PA State Emissions when I drive the car in excess of 5,000 miles per year. The dealer covers the cost of PA State inspection (excluding sticker), and they even paid for Mobil 1 oil changes from about 2003 - 2008.

I am STILL on the original DELCO battery (with assistance from Battery Tender) ... though I did have to pay another GM dealer about $125 to attempt to diagnose a failing battery (not enough CCA - but not covered under warranty).

As if all of that wasn't bad enough ... I *think* I will have to replace the battery in one of the key fobs withn the next few weeks. SO, my question to the legal guru's is ... DO I HAVE CLAIM FOR A LAW SUIT - OR WHAT?

I only hope I am not jinxing myself! Does anyone else have similar experiences?

Don't get me wrong, I do not necessarily have glowing reviews for my local Chevy dealers. Waiting rooms, sales and services areas, and buildings in general seem to be lackluster ... but I am not a fixture in their facilities!

On the second battery in my '99 Coupe, Die Hard Gold for about 5 years now. Had to replace one original Key FOB battery 3 years ago. Still have 4 original TPM's working fine. Nothing else but oil, filter and fluid changes. Purchased with 1,658 miles on the odometer.

I'm confused,,,just WHAT do you think you have for grounds for a lawsuit???Car and fob batteries are consumable item with a finite life span!! Most would have replaced batteries long ago!! Frivolous lawsuits are what drive prices on EVERYTHING in this country!! From the info in your post,,IMO,,you should be ashamed of yourself for even thinking lawsuit!!! I WOULD however be looking for another place for service than someone that charges $125 for diagnosing a dying 9 year old battery!!Should have been replaced a couple years ago anyhow!!

I was being feciscious! As for the battery issue ... it was under warranty at the time ... but, since it was not a covered repair, they charged me for the diagnostic fee (plus towing) ... even though they diagnosed nothing. I would later learn that the batteries are delivered with "x" cranking amps when new. The battery used by Chevrolet has just enough CCA to do the job when the car is new. Apparently (as I am told), as the battery ages, the CCA drops. What this means is, after one year or so, the OEM battery no longer has the proper CCA to handle its tasks.

I took it that the OP was happy with his C5 since the only money he spent was for consumables. Great service from the original battery, even the FOB batteries.

Mine has been great. I have no complaints, similar experience.

Ok, you got me there. That is one word I did not know? I had to leanr American/English at age 12.75 or 13 lol. I'm an import from Mexico. It is a great car you have owned for the last few years sir.

For a second there I thought we had a first year law student on our hands. I hope to have such success. My Mazdaspeed six with keyless pass card feature failed 3 years almost to the day because of the batteries in the pass card, both pass cards! Almost makes me think they had a day counter in the PCM that forced it before it could fail in the field.
