Last year,in my Silverado, I was hit by a 17 yr old girl while turning in the outside of a double right turn to enter the frwy. She was in the inner right and just decided to go straight, clipping my right quarter panel, puting me into a spin on the on ramp. She didn't even slow down. Just kept on going.
At this point, all I could think was "are you friggin' kiddin' me." Shoved it in reverse to get off the on ramp, while I told my son to keep an eye on her. Took me a few miles, but I caught her at a light and she denied it was her. Long story short, I pointed out that her dangling plastic bumper with my paint on it proved different and convinced her that she needed to pull over to exchange info.
Called the police, and when they showed I explained the event. The officer ask if I would like to press charges for hit and run. Not wanting to add insult to injury, I waived that right. I have a daughter the same age and all I could think of at the time was her in the same situation, although I really don't think she would have had then same reaction. I just figured the girl freaked and wasn't thinking straight.
Well the officer took the report from both us. There were no witnesses present, due to the fact I had to chase her halfway across town. She admitted fault, so basically end of story...right. WRONG.
Two days later she changed her mind and stated to her insurance company that I encroached her lane and hit her. WTF. Is this possible?
Yep, sure is. What a hassle. Fortunately, my insurance said is was cut and dry from the original report. They waived my deductible and had the truck repaired. But they needed me to make a supplimentary report to dispute her counter claim. Since the officer mentioned nothing about a hit and run, because I waived that, I had to make a second report to contest him not making any comment on this. Turning this in at the sheriff station was extremely frowned upon. They did not want to accept my supplemental with the explanation that it was basically calling their officer a liar. I can only guess that even though I didn't press charges, he was still suppose to make note of it in his report. I simply told them that this is what my insurance company suggested, beings that this event would be going to arbitration. Therefore they wanted it attached to the original report. Man, if looks could kill, I was a marked man.
If I knew now what I didn't then, I certainly would have charged for hit and run. I assumed there would be an arrest and again I was thinking of my daughter. Had the officer explained to me that she would have just received a citation and with the hindsight of her change in fault, I would have not had any second thoughts. Certainly would have made things a lot easier.
If they hit and then run,,,,,,,,,,no mercy, let them go to court or spend a stay in jail. The next time it could be your or someone else kid that gets hurt by the idiot driver..........................
You should of press charges, she left the scene of an accident, she should of been cited and even arrested. You're a nice person, but you have to leave nice at home some times. If the Police took the report and she admitted to the accident in that report, then you covered insurance wise, just get the report number, give that to your insurance. Now hit her insurance hard, this needs to set an example for that stupid driver.. I too was hit from a young female driver, ON the CELL phone, I watched as she backed up into my PARKED Ram Truck. She lied to me that she wasn't on the CELL phone, my girlfriend and I both saw her. She called her mother, gave me the phone. Her mother asked me if her daughter was on the phone, I told her yes. The mother asked me if I was going to call the Police, I told her I didn't have to, they are already here, ME... the girl started crying again, I told her you should not lie to others and never to a Police Officer, sometimes we are off duty YOUNG LADY.. I love my job...
you know i have the upmost respect for what you do for a living, it's gotta be tough sometimes. i called the police just after this took place, and because i did not get the license plate # or name they said there was nothing they could do.
so i just went with the insurance company, i hope it works out ok. guess we will find out on monday. i will be sure to let you all know what happens. i also want to say thanks to all of you that have replied to my thread, you have made me feel a whole lot better!
Sorry for the situation. If you are handy, you could use the Dupilcolor Perfect Match spray paint to fix an avoid paying your deductible costs. Good guidance on their site. I was quoted $1000 to have my wife's Lexus fixed and did it with their prodcuts for under $30. The wife was very happy and used the money for the C5. My deductible was $500 so you can do the math. thank you sir! not sure if i am gonna even attempt something like doing it myself. i am ok with the wrenches, but when it comes to paint, i have to leave that to the pro's. i will see what the insurance adjusters say first, never say never... let cha know what happens.

I hear ya. If there's ever a next time in that situation, I don't care if it's Betty "friggin" White. She's goin down.
That's when you sue the guy directly. He hit you. If someone else hit him, it's his job to sue them for not only the damage to his car but for his liability for the damage to your car. If the Insurance won't pay, he has to pay it himself. If you let him go, you are the victim.
She called the A hole and politely told him he should get his company to pay or she would be forced to turn it over to the magistrate. A short while later a woman from Allstate called her and threatened her with legal action if she continued to "harrass" their insured. I even tried calling them myself and got no where. I pointed out that his truck would have significant damage to the rear for it to be pushed ahead from a dead stop. They said they were investigating.
The car is an old one and not in pristine condition anyway. But it was damaged. But it hardly seemed worth hiring an attorney and taking on Allstate for $600. If she had collision she could have turned it in to her company and let them duke it out with Allstate....the good hands people. Despite all their slick comercials, they use any reason possible to get out of paying.

I got into a similar situation with dbl left lane. Except I didn't collide with the other car, and I slammed on the horn.
Then a dumbass looking high school kid with Justin Bieber style haircut leaned out of the window telling me to get out and fight.
High school kids shouldn't have bunch of people inside the car.
But sometimes, as a teenager, they need to hit a wall themselves and recover and learn from it. I've been there.
My experience with insurance companies is, if the repair is not very expensive, you are much better off paying for it out of your own pocket. After 2 or 3 claims, regardless of whose fault it was, they put you in a high risk pool, and your rates go sky high for quite some time. i set my deductible as high as i can, $1,000 and pay for the little stuff. Use the insurance if it gets stolen or major damage that you cannot afford to pay.
Also i have noticed that if i tell the repair place that it is not an insurance job...i'm paying for it myself, often the price is cheaper. Figure that.

I feel for ya! its nice to see some honesty, at least. I sure hope the young woman in my story comes forward. and I hope it has a positive outcome for you two.

Not here. I write estimates all the same. I got scamed too many times feeling sorry for people telling me they are paying out of pocket only to learn they turned it in and got a nice fat insurance check. I say let me see the insurance estimate and we will go from there. If I can help with deductible I will but no gaurantees.
Lady was just here with a new Toyota someone aledgedly backed into. Needs a new rear bumper cover & paint...$600 job. She is upset cause she has $500 deductible. Unless she takes it out and backs it into a pole at 35mph, I don't see her saving any of that 500.

Thankfully the damage looks relatively minor. Too bad you didn't get her tag number - she deserves to be arrested and to pay for the damage. Good luck getting the car fixed.
just to let everyone that replied to my thread know, i was at the insurance company on Mon., looks like almost $1000 damage. just waiting to hear from them regarding taking it in to the bodyshop and having it repaired. as it happens it's a good opportunity to get a deep scratch fixed on my drivers quarter at the same time.
