Can I use a oil tube and dipstick from a 5.3 in my c5

Why not just buy a replacement?
If you could lay them side by side and they are pretty much identical, I'd guess you could. However having the improper oil level in your car is a huge No-NO.

I need 1 that doesn't bolt on the headers that's y and I already have 1

I think what you want is the later style dip stick for corvettes. Look for the dipsticktube for a 2001+ corvette. I switched to it when I put long tubes on mine. It will secure to a hole located in the head.

I really doubt the dipstick you have is designed with the batwing pan in mind. It is possible you could get luck I guess.
