Does anyone have any prior experience dealing with the Lemon Law???
My 01 has been in an out of the shop since I bought it with computer problems, fuel gauge problems, transmission rebuit, seat covers replaced three times and the instrument cluster replaced twice. Just to mention the major stuff. I have called GM and they are doing the research on a buy back or extending the warrarnty but I can only imagine what is going to happen when that is up. Needless to say I am very depressed I love my car..
Any insight on how to handle this process would be appreciated.
My understanding is that each State's law can be significantly different. Thus you would need to research the Florida law, if it exists. I would suggest the Florida Department of Consumer Affairs or the State Attorney General to start finding out what your rights are.
Another option is to go to the State of Florida website and do a serach for a Lemon Law.
I used the Lemon Law once. I really didn't want to and wasn't even sure my problem qualified. I had a fuel gauge problem on a 3 year old truck. Well it turned out that it did qualify. Then manufacture bought the truck back minus mileage. I hated turning a perfectly kept vehicle (except for the fuel gauge problem), back in. But I could no longer take the gauge problem. I'd fill the tank and the indicator would only go to 3/4 of a tank. Everything the dealership did to correct it only worked for a little while.
Anyway the laws do vary slightly from state to state. The big thing is to keep your receipts. I didn't have to pay anything unless we won. Just contact a Lemon Law Lawyer.
Sorry to hear about your problems. Run a search on archived topics in the C5 Tech and C5 General Discussion for any postings with my name, or just type in Lemon Law and you'll probably find a LOT of old stuff I typed on the forum. And feel free to write me once you've read through it all. I'll give you my phone number through e-mail and we can talk if you're interested.
Good luck. If you go the Lemon Law route, be prepared for a small personal nightmare.... not that what you and your car are going through right now ISN'T a nightmare...
Have you tried changing dealerships yet? Post on here and see if you can find a dealer that people consider competent. In retrospect, having a bad dealer/service lead to more problems than would have come up anyway. Really makes you want to :U and definitely makes you :mad :skep: especially when you paid top dollar for the car thinking it would all be :flag   :steering:
But get ready because GM is going to try to play you like a :_dupe:
Sorry for all the faces. Talk to you soon.
Thanks I have doing some research and have found a guy in th ZO6 Vette
forum that had a buy back and he had all of the same problems that I have.
He posted all of his letters to GM and finally got a new car..
I appreciate your willingness to help and I will be in touch.
I have used the Lemon Law twice in CA for GM vehicles. Looking back it was fairly straightforward, although at the time buying a car and having it in the shop was not pleasant at all.
Get all your documentation together and call the better business bureau, they give you information on how to proceed and what to expect.
Forget calling the better business bureau. Just contact a Lemon Law Attorney. As I said, they will only charge you if they win and won't take the case unless they know they can win. I used an attorney that was 6 hours south of me. Faxed them all my service paperwork and mailed me everything else. It was a breeze.
Sorry to hear about your and other's lemon law candidates. Scary to think about low-mileage, slightly used Vettes on dealers' used car lots. Many are lemon buy backs. I heard they do not have to disclose the used car as a lemon buy back and sell them with factory warranties. Has anyone heard the same thing?
Here is Florida's Lemon Law. P.S. I am providing this as a concerne citizen, not as an attorney (I'm licensed in MN, but not Florida yet. FL bar is in two weeks.) http://www.800helpfla.com/lemon_text.html
