I was hit head-on back in February and had it sent to a bodyshop renown for it's body/paint work in Huntington Beach, Ca.
EVERY week for the past 3 months I call and get the same responce "I should have it ready next week". EVERY WEEK. Granted, I can understand a few instances of delays regarding parts and misc repairs that weren't discovered until later.
I've reached the boiling point.
He has already been paid by the insurance company and since I didn't send it to a preferred bodyshop, the problem is mine to deal with.
I was wondering if there's any state law, etc. that can force him to finish my car or ANY other option that I can take.

You should have issue still with your insurance...yes, they do work for you!! As for the shop...you can notify BBB, and possibly legal action. Have you been to the shop to inspect or discuss the actual holdup and why??

My insurance company (USAA) says there's not much they can do at this point - he's already been paid for the damages months ago. They said that the best I can do is have it taken to another shop and have the current shop refund the diff to get it finished.
I have inspected the car many times and until 2 weeks ago has been in pieces..... but everything was painted and ready go at least. As I said before he has had the car for 6 months and according to his contract, he needs one week for every $1000 damage. His reasons last week were that he needed to install the front bumper, align the susp, charge the AC, and give it a 10mile test drive. This week he says it needs a new spring and some other things but my ears shut and I almost passed out when he said it'll be finished maybe next Wednesday.

Your insurance company should still get involved and make sure you get your car back (1) done right and (2) within a reasonable period of time. Get on them, that is what you pay premiums for.
Give him some local TV coverage!!! Tell him that you are giong to invite the local NEWS station down to find out why it takes 6 WEEKS to fix your car! I am quite sure that he will change his tune!
Nobody wants BAD publicity!
See if the local TV stations will do a segment on rip off car repairs!

Has he NO respect that driving season is short?
Contact your local news channel, BBB bureau, and Chamber of Commerce to review his practices.
If possible, get the car out of there.

I've heard that USAA is probably one of the best companies from an insured's standpoint. You've got a lazy adjuster! He ought to be on that shop like the proverbial "stink on poopoo". Insurance companies have allowed us to believe that they do us a favor by representing us. WRONG! They work for us and don't let them forget it!

Something fishy here with the insurance company. Why would they pay the shop direct in full before the work was finished? Is the Adjuster working with the shop or did the Vette owner give the check for the full amount to the shop? With no money held back, the shop has no incentive to finish the job, especially if they bid low. Also, who's insurance is paying, the Vette owner or the car that hit him? If it's the latter, they aren't going to do anything.

Never pay anyone the full amount for any type of work until the job is completed
