Once, my E-Z did not register when I had it in the console.
I think because my arm was resting on the console blocking it.
Other times it did register.
your arm is not going to stop RF (Radio Frequency) from reaching the reciever.
CTHusker, thanks for the !! Although I have not been involved in law enforcement or traffic control, I have seen the aftermath of some nasty collisions at toll plazas over the years. Glad you brought it up.

My experience is similar: in my truck the transponder sits on a piece of rubbery material on the dashboard (designed for cell phones) with the windshield side DOWN, and it works perfectly. But in my Nissan, I had mis-reads about 10% of the time until I flipped it over.
More importantly, if the long axis of the transponder was parallel with the axis of the vehicle, 100% mis-reads. Just turned it 90 degrees, i.e. the same way it is supposed to sit on the windshield, 0% mis-reads.
I am going to try the "Keep it in the console" tactic, but with the windshield side up, and transverse to the cars axis, and probably taped to the console lid to keep the correct orientation.
