Correction - I did not mean to say they will give him a new car - you are right. But under Lemon laws - they can be forced to buy his back if they don't fix it.
I'm sure some adjustments in the top system will fix the problem....In CA the lemon law expires after 18 months or 18K miles, whichever comes first....not sure when he took delivery on the vehicle....
My 06 top does this as well when both seats are fully back. The seat back pushes on the glass enough that the cover "taps" it on the way up. There is actually a small metal strip on the inside of the glass just where the cover taps it that appears to be a "bumper" to keep the cover from touching the glass.
Seems to be working as designed. It is a minor annoyance to me.
It takes seconds to put the top up and down manually, and without effort. I dont want a power top and most likely never will (hence why I am getting the 2LT instead). More parts to go wrong, wear out or break completely!
I have the same problem and I have an 07 with the manual top. Before I lower or raise the top, I have to push the window in with my hand to make sure that it does not snag. There is already some damage to the bottom of the window because of this.
I just had my inner lining replaced three weeks ago because it ripped and the new lining is already showing signs of wear. I should have mentioned the window problem to the tech, I guess I will when the second lining rips again.
Hey guys I have been having a nightmare dealing with the dealer on fixing my 06 vert.
The problem is that the lid for the top will hit the rear glass area when I put my top up and down. Sometimes it hits so Hard it feels like its going to break the glass.
I have been to the dealer atleast 5 times rgarding this issue and they always seem to come up with a temporary fix but the same problem arises the next day.
They are no longer going to try and fix it as now they are telling me its a common problem.
DOes anybody else have this problem with their VERT???
If not what should I do?

I never noticed it before but mine is doing it too. Might be because of the cold only 36 degrees when I made the movie. Check out the movie around the 5 second mark look at the middle of the rear glass and you can see the back end of the top move slightly, if you listen close and put up the vol you can hear it click as it hits the plastic trim around the glass mounting frame. Not going to worry about it now as it going into winter storage tomorrow, a problem to deal with in the spring. It doesn't look like a big deal, worse comes to worse I'll just put a small piece of black felt on the window frame.
I would have said that I have no trouble with my power top but, after watching that clip It makes me question whether or not I'm having the same problem.
This will make everyone with the power top wonder.
I have an 06 vert and have NEVER seen the parts hit each other when opening or closing the power top! I will watch it today and see how close it gets...but sounds your dealer needs a tech lesson!!
edit: Just went out and watched it....the window gets pulled UP and well out of the way as the cover closes...no way it could or should ever hit the window!!

This is the exact same problem I have with my top when it goes UP and DOWN. It used to hit even harder but after the 5th adjustment it hits as hard as yours does.
So now that all of you can see the problem I am experiencing is it worth hassling it over with the dealer? is it really that big of a deal or am I just really **** about my vette? lol
And also I have some wear lines on the sides of the top is this common?

Ive got 10,700 miles and have owned it for 14 months as the first owner

Not to be critical, but you should put the top release handle back in its cubby hole before you lower your top (whre it is when the top is locked). Otherwise the tonneau cover really presses hard against it when the top is down.
If the window is not pulling far enough out of the way, you may have a micro-switch problem. The top pulls the window up til it hits a micro switch (where the rear of the top pivots). then the pump shuts off. If the switch fires too soon or sticks. the glass won't pull out of the way.
Second, if anyone has ever tried to manually close the tonneau when the hyd pump is pressurized, you can bend the tonneau hinges. you would prolly see the front of the top hitting before the rear here.

Sorry guys, but I had to go see for myself. It's below 50deg outside. I lowered my top and the tonneau doesn't come anywhere near the top or the glass. I have at least 3 inches of clearance between the tonneau locking mech and the bottom of the vert top. The window doesn't even come close to it.
Find a competent dealer and have him check it out. Don't let them give you the BS that it's normal.
