ha guys and girls,i got a ticket on I75 in byron ga for 87 in a 70.first ticket in 20 years.does anyone know how the traffic courts work in ga. ga has a additional fine of 200 dollars over the speed of 85.if i go on my court date and plead guilty would the judge lower my ticket?if he lowers my ticket buy 3 mph the ticket will not be reported to my insurance co and no points will be assested.thanks all..
I don't know anything specific about Georgia law but a couple thoughts come-to-mind. First, I doubt a judge can change the speed you were actually going. You might request a pre-trial or pre-hearing meeting with the prosecutor to explore the possibility of their accepting your guilty plea to a 'lesser' charge...perhaps one that had a similar monetary fine but not the excessive speeding component. I'd also check the citation carefully for any mistakes or material errors (I just got a speeding ticket dismissed for my daughter because the officer wrote her date of birth wrong). If all else fails and depending on your particular circumstances it might be worthwhile to fight the charge. I'd consider hiring an attorney if you go that route.
If you somehow avoid the excessive speeding charge but still receive a citation for speeding, why wouldn't your insurance company discover this and why wouldn't points be assessed against your license for speeding? Would avoiding the excessive speeding charge then make you eligible for some type of driver's education class that many states have for first-time offenders with 'minor' traffic offenses to avoid getting points assessed?
This is neither here nor there but it seems strange to consider "excessive" speeding anything over 85. Considering you can probably drive 75 legally on an Interstate...that's only 10 over a posted limit. It just seems odd to consider 10 over a legal limit as excessive.
Two options, speak with the DA and see if you can plead guilty to something else besides speeding, with your record they may do that. Second get a Lawyer and have him/her plea bargain it for you.
Ask for driving school or a deferred ticket. Call the officers station and talk to him and see if you can work out a plea with him, or just arrive early to court and talk to him. You don't need a lawyer.
As for what the Judge can do, he can do pretty much w/e he/she wants and dismiss it altogether. If the cop doesn't show to court here, it's dismissed. If the cop says you've reached a plea, the Judge will generally accept that.
