It should not have any power to it if you are not applying your brakes and you say it stays on but not the actual brake lights. I would say you have a short somewhere in the wiring going to that light.

Thanks for the reply....I guess a short is possible. Car only has 18,000 miles. It just stays on real dim. Maybe a ground wire loose?
I would check the brake light switch first and make sure the switch is not stuck in the closed position when your not pushing on the pedal, i would think if you had a short in the system you would be blowing fuses.
Have you replaced some of your OEM light bulbs with LED lights (without installing any resistors)? Some times this will cause LED lights (your center brake light is LED) to stay on very dim because the added LED bulbs don't offer the same resistance as OEM bulbs.

I'd bet a day's pay (not really ) there is corrosion in the main harness connector located inside the rear fascia. You access it by removing the passenger side taillight, usually the inner one. See example below:
