Default Tuner not accepting codes

So I am trying to put on my Diablo tuner and its not accepting the codes...I called the guy I bought it from and he said with the 2005 C6 for some reason the computer has to be "flashed" by Chevy in order to be wiped clean so I can program my tuner. Has anyone else heard of this problem?

Did you buy the handheld unit used??
If you bought it from another person and they did not return their vehicle back to stock via the programmer, it will not work on another car, it is locked for that vehicle VIN only.

certain 2005 cars have to have their PCM program updated before you install a diablo tune. Dealer will normally do it for free as it falls under emissions warranty.

so called dealership and asked for update and they wanna charge hour and half of labor...has any one else had this problem? i mentioned the emiisions warranty and they said no?
