In the case of performance parts that claim to change the performance of other OEM parts this is different.
As you said, the dealership should reasonably be able to convince a judge that your aftermarket part contributed to the part failure or "reduced it's lifespan". The wording in the actual act. This "shouldn't" happen with a Borla catback imo. But that's just my opinion.
In reality what can happen if the manufacturer perceives your aftermarket performance part contributed to the part failure,?
1. they will deny your warranty claim.
2. At this point you can wave a largely irrelevant MM Act printout at them but chances are they are already extremely familiar with the MM Act.
3. Next you can appeal to them. Contact your ftc, ctc etc.
4. Next you can have a hundred dollar lawyer letter written.
5. Next you take them to court. You had better come with your own engineers that are more believable to the judge than theirs are.
This is going to cost you A LOT of money btw.
And if you lose.... which you may very well do if your own performance parts advertising claims to alter OEM engine performance and if their engineers appear credible....then you will be paying for the repair and several thousand in legal and expert witness fees.

All that said the Borla exhaust is the safest to go with imo
They are very careful to make ZERO written claims of horsepower increases in their advertising. It's no wonder why that is. Smart decision.
They also have a GM approved version which is likely arguably quite similar in design as the S and Atak.
There really "shouldn't" be an issue with a Borla catback but no aftermarket PERFORMANCE manufacturer that doesn't have written approval from the car manufacturer can say their product will not impact a warranty claim.
Even GM says it may....in writing...
That said, since Borla themselves did say in writing that their product will not cause a warranty claim issue you are now covered.
This is quite frankly awesome of them.
If you do have a claim issue I would ask Borla to step in as they claim their product will not encounter one.
If anything it's a great reason to choose them.
