I noticed that you've mentioned the Mershon's Sales Agent and Sales Manager, as people you have spoken to concerning making your deal "right". Everyone has a "boss". Have you spoken to the owner of Mershon's yet? On Mershon's website, under Meet The Team, they have Dan Mershon's picture and email address. Mershon's receptionist should also be able to put you in touch with him, especially if you mention your situation and potential litigation. If the owner will not stand behind his dealership/business, litigation may be your only hope. Giving him the opportunity to hear your side of the story and what you would like to see happen to "make it right" before things get really ugly might be a good next step. Who knows, perhaps he's not even aware of the situation. Even worse, he might be aware and fully supportive of his employee's actions - to date.
Since this thread is solely on the dispute involving this purchase, and resulting commentary on that dealer, the thread belongs in the Transaction Feedback section.

Not saying who s at fault here but I learned a long time ago there are three sides to every story. Your, theirs and somewhere in between lies the truth. The bottom line is you or a professional should have inspected the car before you pulled the trigger. If it ran that bad and didn’t stop well you would have known that on a test drive.

Agree. How many ads post the casting number and fail to disclose the suffix? That would have been my first question to the dealer. $300 and a phone call to an inspector would have saved this buyer a lot of time and trouble. Plastic P is right. It isn't advertised as an original 340 car. Good luck finding an attorney who will take this on a contingency.

The OP has stated several times that he has talked with an attorney, so constant suggestions to contact an attorney has been addressed.
Another point, it doesn't do much good to threaten to sue the other party, since they know that you are not happy. When they are contacted by an attorney seeking some answers or receive a copy of the court filing that they are now a defendant, they usually sit up and take notice at that time. This is not Mershon's first rodeo.
OP, sounds like you are taking the correct path.
On another similar note is the story where the owner of C8 took it in for repairs in California, saw his video on the PDR where the mechanic was racing another car on the freeway in excess of 100mph. That auto dealership took the C8 back and let the aggrieved owner order a new C8 with some additional options with no cost to aggrieved owner. Mershon's should take note.
