Friday morning @ 5am going to work. The bad part I wasn’t even in the Vette. Got nabbed for 67 in a 45 Got smacked with a reckless driving citation (VA laws suck) and I'll get fined for the abusive driver fines as well if it hold up in court. Any legal types out there that can answer a few question. The officer pulled me over on a road the offense was not committed on. I had turned right before he caught up with me. The ticket says the offence occurred on HWY 29 but he pulled me on Route 605. He wrote on the ticket Route 609. There is a 609 but it is in a different county. Can this minor typo be enough to get it throw out with or without a lawyer? I have legal services as a benefit at work and will use them.

Don't know about VA laws, in Iowa the ticket can be amended by the officer if there is a "typo" before and during court. And as for the location of stop, shouldn't make a difference (??) Iowa, law enforcement has 1 year to write a citation from the date of the infraction. If I was the officer and was able to get hold of your above admission of guilt ........... you would be paying fines.
Not trying to be a smart a _ _, but if you knowingly know you have a problem w/ speeding ........ try using the cruise control and get up 10 minutes earlier to leave for work. Just trying to safe lives
Sorry, BUT you can't speed 'ALL THE TIME' and not expect to get nabbed sooner or later.... and now you want help in tripping up the cop who was doing what you pay him to do. Wow!
Regards,
Alan
Just pay the fine and ask for traffic school, if they will let you, being it was more than 20 over the posted limit. Im some states, anything over 20, you talk to the judge after you get out of the jail cell. Be happy you got off as well as you did. You must have pissed the cop off. Usually, they will knock of 5 mph or more unless you give any static. I have found that if you just pull over, turn off the motor and put your keys in plain sight (on the dash), you stand a much better chance of getting off or at least having the lesser charge written on the ticket. (I get pulled over alot for seatbelt. I have an "exempt card" issued by the state, due to left shoulder problems. I can't get cited for no seatbelt.) Good luck and go to traffic school.
My wife got her very first ticker last year. She was doing about 75 in a speed trap 50 and the Oregon State trooper wrote her for 69, which waqs rather cool. We got rather lucky when we thought we would ride it out in court. 6 months later, we showed up to the court house, but the trooper must have needed more doughnuts. Needless to say, her record still stands. No tickets! No show cop and She walked !! I love it!

Unfortunately, I have some experience with this from the time I was living in Roanoke, VA. The officer has the right to "ammend" the ticket and it will stand up in court. Your only hope in VA is that you go to court and he does not show up. I would just pay the fine and slow it down, but that's just me talking.

Good luck with it............
Well, I don't know about VA laws but up north in NY you can postpone a court hearing 3X by the time the court hearing doe's come around the court may want to plea bargain, Or the cop will forget all about the ticket and not show.. It is worth a try. However I would contact a Lawyer type and make sure you cover all your bases, The ticket is nothing compared to what will happen to your Insurance rates... Good luck Bro.
I just got a ticket going 76 in a 55. Rural area, no other traffic, clear, sunny, dry roads. Went to court. $185 fine, Conditional discharge for 6 months. No tickets in 6 months it is off my record.
I've found that leaving early and giving yourself enough time where you don't have to speed is the best way to avoid a ticket.
I see people all the time speeding because they "need" go get to work but then are pulled over and guess what? they end up getting to work much later then if they left early OR just drove the speed limit...not to mention the wallet won't be lighter either.
ill tell you the best thing to do when you get pulled over; first pull to the right as soon as possible using your signal, roll down your window and put your hands on the top of the steering wheel so that they can be seen in the side mirror when the cop is approaching and wait for them to ask you for your license, registration, and insurance. let them know that you may have to either reach in the glove box or under the seat for anything. don't ask "can i see your radar?" and make up excuses because trust me, they've heard them all. most of the time, the cop will respect the fact that you're courteous, and most important, remember that they're just doing their job. as far as going to court; in our municipal court if you contest a citation, you have a "bench trial" where you can represent yourself and the cop has the city attorney on his side. if you've never represented yourself, trust me, you can really look like a doofus when the city attorney gets ahold of you. however, if you go really prepared, it can be really bad for the cop. a guy here once asked to see the records for the required yearly calibration from the radar, which is public record, that was used in his citation for speeding; the records could not be located and guess what? not guilty.
Hey man just pay the lawyer to get you out of it. For all of those that say slow down or that he's weasling out of it.. BLAH BLAH BLAH... Tickets are revenue generation and especially in the People's Republic of Virginia. The current fines were instated to do nothing but generate revenue....
You got a 50/50 chance with the police officer writing the wrong location. Its going to be up to you in how you present that the officer was not aware of his location how is he sure i was speeding type of argument. In California reckless driving is a misdomeanor and booking is required. It is also a 7 year deal on your record and traffic school is not an option unless the judges rules it. When i got mine it wasn't the fine of $340.00 that hurt it was the points on the driving record that resulted in over $750.00 insurance for 6 months liability only. Oh yeah this was in 1985. good Luck
You're not going to get off from a 605 vs. 609 discrepancy. Time to pay up and get a new radar detector. If you're in Virginia, the best thing to do is get one that has the audio out jack (headphone sized), mount it outside the vehicle somewhere like in the front grill or somewhere it won't be seen, and then run the audio cable to your stereo so you can hear if it goes off.
