Well, if he accepted the package without opening it in front of the carrier, there is no way the carrier would pay a damage claim, even if it was broken during shipping. I would bet that if you call the carrier who delivered that piece to the buyer you will find that the buyer tried to claim damage and was denied. THEN, he claimed it was that way when you shipped it in order to get his money back.

If this turns out to be the case, the carrier should be willing to send you an e-mail with confirmation that you can send to eBay. If so, the deal will be reversed for you. But, if the guy broke it during installation, there will not be any firm evidence to support your position; and it sounds like eBay is choosing to support the buyer on this one. {But I sure don't see how... }

John, I edited my post. I was off topic and venting about ebay not protecting the buyer. Sorry about that.

This guy is a real peice of work. He screwed up the dash, probably punched it, and now is blaming everyone but himself. I hate to point fingers at a generation, but this latest one has a hard time telling the truth or being honest. Not sure why.

avalonjohn, I wish that dash pad was broken on the buyer's head. this guys is a real jerk!

Don't give up with him, try to report what he did to paypal and explain to them how he scammed them.

The whole scenario has been one bad experience for you. I question though that PayPal is going to pay both of you and be left holding the bag. I'll be interested in the final outcome of that part. Keep us posted.

I am going to go against the grain here and call that intentional and retailatory. I don't believe that it completely broke in two installing it...what did he do, flex it, hear it crack, and then keep on bowing it until THAT happened?

My dash is cracked (by me:o) and it is nothing like that. It is 100% useable, with only surface cracks that are visible in the vinyl.

You know he had to be following this thread; and all of the posts probably didn't sit too well with him, not to mention the back and forth with ebay.

As abraisive as the buyer sounds, and as escalated as the matter became, I would not be shocked if he did break it over his knee before boxing it back up.

My vote is for vindictive damage.

he needs an attitude adjustment

Looks to me like he broke it trying to install it and is now trying to get someone else to pay for his screw up.

I have broken many a part trying to work with it, but never blamed anyone but myself!!! Latest was the new windshield put in my 67 Chevelle.......................

I agree. This is deliberate damage.
You SHOULD be able to use his words to Paypal about "sun cracking" against him to show Paypal he broke it on purpose.

well, we sill see. The appeal was opened about 10 minutes after receiving the "what's left of" dash. Please, if any of you have an idea who this guy is, be careful if you sell to him.

He obviously needs a team of treatment workers....also, he has no idea how to restore a Corvette.

I really don't think ebay cares about much more then their bottom line,I bought a $4000.00 Oliver tractor that was listed as having 847 original hours on it,ebay sided with the seller WITHOUT seeing any evidence from me, after two trips to Wisconsin I won a court judgement against the seller.

Placed a lien on his property

Filing a contempt of court paper along with a motion for telephone apperance on him.

Next step is garnishment from his accounts after I receive his financial statement that he has not filed with the court (can you say digging a deeper hole)

another ebay issue

Bought a wiper relay switch,sent check,received item,Now ebay has opened a case against me for non payment of item.

and another issue with the post office now

Bought a steering column from another member here,it arrived with paint scraped off,lock ring bent, box looked fine on the outside.It was marked with two big orange fragile stickers on the box,do you think anyone can read & understand that word, ? apparently not.

After reading your post and going through the of dealing with ebay I am seriously thinking of closing my account there.Paypal account has been closed already after I changed bank accounts they kept sending payments requests to the former bank,now I have 4 overdraft charges pending at a regions bank that also has been closed.

Hope you have better luck on your dash problem then I am having.

well, I expected it come back as either A) his original dash, or B)...my dash...I never in a million yrs thought it would come back cracked in half! This guy got upset at his inability to install it and wrecked it. Hopefully, the "investigators" will see the evidence and find in my favor.

My brother in law stopped by tonight with the kids for Halloween.he really hit the nail on the head when I showed it to him. He asked why would someone ruin a 43 yr old part of American history?????

Thats exactly what happened............it happens a lot with old brittle parts that need slight bending to install..........& the dash pad is one of those parts !!!

the buyer described himself as a perfectionist...(aren't we all here?).....he spoke a mile a minute on the phone, like a used car salesman. he additionally told me he was in "a rush" to get the interior installed as his car was going to be painted shortly (i know, why would you install an interior before paint?)...so, there is CLEAR evidence he was rushing, tried to install it and it cracked. i doubt it broke in half during installation, but in my opinion, after dealing with him ( i consider myself a pretty good judge of character)....he damaged it, had a hissy fit, and snapped it in half.
his original claim to paypal stated it was "brittle".........he never ever said anything about it being broken in half!!! first off, it was not brittle, or i would have never bought it a while back in the first place. second, he was in a rush, and lastly he does not know diddly about Corvettes......(he did not even know his car came with smog, but claims to be restoring it to original!)
i am in for a fight here guys and i never ever back down from one. stay tuned. thanks again for all the support!!
