First thing I'd do is check the switch under the dash. It's activated by the brake pedal. Press the pedal down and activate the switch by hand, the lights should come off and on. If not, get a meter and check the switch. I'd have to guess it's probably the switch from your description.

, but, also check the ground at the rear harness. It bolts to the frame on the driver's side. If that ground is weak or you have a breaking wire at the terminal, the functions could be intermittent.
