It is possible. Now that its at the full mark has it leaked at all since? If its at the right level and there are no new puddles I suspect he over filled it.

Default here's the scoop

Ok, I finally talked with my ex about the gasket. He said that when he replaced the speedo seal at that time he noticed the shifter shaft seal was leaking but he didn't fix it cause "it wasn't leaking bad enough?" (what are your thoughts on that). He said that I shouldn't take it anywhere but to an Aamco cause they are the only ones that will have the tool to fix it. (and of course he wanted me to take it to his friend's aamco shop). Last night I checked the steering fluid (but that isn't red enough and it was ok) and the puddle from the "shifter shaft seal) is right under the drivers seat maybe a little more towards the middle of the car. It appears to have stopped leaking for now cause the dip stick is reading in the middle instead of the top, but I'm inclined to think it will only get worse and need to get it fixed right?

The shifter shaft seal leak is easily corrected...and you don't need any special tools. Go to NAPA and purchase a 'replacement' seal. Then take it to any [competent] mechanic (not to Aamco or any tire or muffler chain store). Tell them to remove the linkage from the shifter shaft, clean up the shifter shaft and shaft bore, then put some Vasoline on the new seal lip, and carefully [so as to not cut the seal on the shaft flats] install the new seal OVER the old one and drive it down below the flats on the shaft. You will then have two seals on that shaft: one which leaks a bit, and a new one that stops the little bit of leakage coming to it.

{Some folks will tell you this is an 'improper' or 'Bubba' fix. The fact of the matter is that this is what the transmission shops do with such a unit that only has one seal on that shaft. That second seal will probably last longer than the first one ever did.}
