Georgia BS beware
The cop was yelling at her to return to her car it was not safe out here, she asked him why he was out here if it was not safe, she gave the YMCA van behind us her card walked back to her car and drove off in her Lexus sending the officer a one finger salute as she drove off honking her horn.
I went to court with the lawyer and she plea bargined to $75.00 and zero points. She said we could go to state court and win but all of our time if we spent all day in court would cost more than $75 Oh, by the way: I had my friend in the passenger seat count the cars that passed us in the right lane once he told me the reason I was getting the ticket. 173 cars!! [/B]

I guess the one good thing to come out of that was the fact that your lawyer got pulled at the same time. I'll give the lady credit for flying that bird without a license To have you stop on an interstate is asking for an accident to happen, and it probably will, and then someone should sue the state for an idiotic law. I’m all for slowing down or moving over one lane, been doing it in TN long before the law, which did not take affect until last July. However, to have you come to a complete stop on an interstate is ludicrous.
This law is similar to laws in most other states, and includes all emergency vehicles such as fire, EMS, police and “tow trucks.” Vehicles must have their emergency lights on, so you don’t have to stop or pull over for a LEO sitting with his radar unit.
Edited to add the following information:
I got curious, so I looked up Georgia's code on LexisNexis, and you are NOT required to stop. Their law is identical to TN.
Here is the entire Georgia Code, Title 40-6-16, that pertains to their "move-over" law. Only 40-6-16, Section a, subsection 2; pertains to your ticket.
a. The operator of a motor vehicle approaching a stationary authorized emergency vehicle that is displaying flashing yellow, amber, white, red, or blue lights shall approach the authorized emergency vehicle with due caution and shall, absent any other direction by a peace officer, proceed as follows:
1. Make a lane change into a lane not adjacent to the authorized emergency vehicle if possible in the existing safety and traffic conditions; or
2. If a lane change under paragraph (1) of this subsection would be impossible, prohibited by law, or unsafe, reduce the speed of the motor vehicle to a reasonable and proper speed for the existing road and traffic conditions, which speed shall be less than the posted speed limit, and be prepared to stop.
b. The operator of a motor vehicle approaching a stationary towing or recovery vehicle or a stationary highway maintenance vehicle that is displaying flashing yellow, amber, or red lights shall approach the vehicle with due caution and shall, absent any other direction by a peace officer, proceed as follows:
1. Make a lane change into a lane not adjacent to the towing, recovery, or highway maintenance vehicle if possible in the existing safety and traffic conditions; or
2. If a lane change under paragraph (1) of this subsection would be impossible, prohibited by law, or unsafe, reduce the speed of the motor vehicle to a reasonable and proper speed for the existing road and traffic conditions, which speed shall be less than the posted speed limit, and be prepared to stop.
c. Violation of subsection (a) or (b) of this Code section shall be punished by a fine of $500.00.
Sounds like the lady attorney was not that good, since the speed is subjective, and you followed the law if you reduced to less than the speed limit and were ready to stop.

Something like that happened to my girlfriend. She was driving through atlanta down from Michigan. She got pulled over in the middle lane with cars going by her on the left. when she finally pulled off to the right the cop tol dher she was speeding. She was kind of miffed and ask how fast because as far as she knew she was doing the speed limit and was being passed. The cop told her she was doing 14 miles over the speed limit and his partner on the bridge she went under a few miles back had the radar. He gave her a ticket and said she could go to court in 4 weeks to fight it if she wanted. She had MI tags and told him she was only down in GA for 4 days. He said you either pay it or go to court and walked away.

I'm not sure what the EXACT law is but if you are suppose to stop, that's ridiculous.... Can you imagine stopping on a highway when the speedlimit is 70 and most cars are running an easy 10mph over the limit?
I think in NC, you're suppose to drop your speed at least 20 mph when going past....
I understand the dangers that exist for an officer when standing on the side of a busy highway but coming to a complete stop I think creates a larger hazard.

Also, I have to agree - that law sounds whacked - But this individual has issues.
