How did you get into this mess? Did they change your transmission fluid? I get my oil changes done at my local Jiffy Lube but will no longer let them change tranny fluid since they started using the backflush equipment that doesn't require them to drop the pan. You can't backflush a transmission filter.
We've been through this before. Yes, 1/12 qts low CAN damage the tranny. But, if there was debris in the pan when the dropped it they should have shown it to you. They risk this exact problem you are going through. If they don't show you the pan and it's got debris in it, they can't prove it happened before you brought it to them. Your word against theirs. Good luck. Always, always, look at the pan before it's cleaned if you are having it done by someone.
Most states have raised small claims limit to $5,000- go get him. Don't mess around with his bs of it was an old tranny. If it was OK before the work and not afterward, it's on his dime.

You should have a new one now because he broke yours. Your used one was working fine until it was "serviced" by his inept shop.
