Man, glad you are ok! This is a shame. Its like a fine pc of china that got broke and really can't be replaced. Another FRC gets murdered. By last research the count for the '99 was down to a little under 2100 and the '00 a little under 1100. Sure hope you can get another one. These figures are from as good of research as possible. Checking each state data base for '99 & '00 for 1YY12's. Its not easy but needs to be done. The FRC slowly but surely is being modded and wrecked. Give 'em five more yrs and they will be almost untouchable. Sorry about your FRC.

And this is not a " what if? " scenario. The way I posted is exactly the way it happens in court. Your lawyer can let you explain on direct but on cross you WILL be directed by the judge to answer YES or NO to the questions posed. You can refuse to answer and plead the 5th but other then that you will be required to answer. Your lawyer can object to the question if it calls for speculation etc. but if the judge rules against the objection you will answer or be found in contempt.

That said my strong suggestion to the OP is to say nothing and let you lawyer do the talking. That would include retracting his version on this Forum.

BTW. I took Criminal Law and Investigation in College.

I'm not disagreeing with you, just pointing out that it doesn't always go the same way in court. Sat in a few cases like these... and I took the the same course in college too.

Yep.. that witness would have to testify to that for your charges to be held up.

have the witness identify the drivers of the vehicles..

So where is the other guys car? Let me guess they got away?

Again No disrespect to the OP...but hitting 80 mph trying to out run a drunk is not very bright.
Obvious from the result.

And extremely hard to use the fact the other driver was DUI as mitigating circumstance.

Did the rear rim really break off the spokes like in the picture?
