Well allstate just called me to let me know that the ladies insurance (AAA) will be taking full responsibility. Still waiting to her about the vette.
Thats very unusual. Insurance companies play a percentage game. Your car could be parked in your driveway and get hit by an out of control car and you will be found about 10% at fault for parking outside your garage. Thats the silly game they play between each other. Those numbers play out to the percentages that each company will pay for the damage.
In your case, you are at least 25% at fault (in the insurance game Allstate would pay 25% of the total) because you were driving and did not avoid the crash.
It does not affect our driving record in any way, its merely an insurance industry thing.
If they total it, buy it back and sell the driveytrain and PCM on the GTM boards. They pay a good price for donor C5s.

That is not how it works. The insurance company pays out when there is a party determined to be 51% or more at fault. If the number is 50/50 then both parties take respective ownership of their own clients. The percentages are only used in determining the at fault party.
What you're saying is if I get hit in my driveway I only get 90% of the payout because I'm 10% at fault and it doesn't work that way.

That's not how it works. When I got hit and damage was on both cars there insurence paid 100 percent of everything. When my girls car got hit they paid 100 percent as well. When a car is damaged they determine total or repair based on 80 percent of the value of the car. If the repairs are more than then they total they will offer buy back at 10 percent of the payout amount. I should no as my brother owns his own shop and we do insurence auctions daily. Might be different in fla as most things are, but unless the executives at the Hartford, travelers and 21st century are lying to me and they are personal friends I tend to believe them. But every situation is in itself a different matter

This is not always true, it depends on what state you live in.
So the vette will be getting repaired. They said they would cover up to $20k on my car. So far the damages are at $11.5 They even said the value of the car was at $29k, when i saw that on the paper work i wished they would've just gave me the cash instead. oh well.
Looks like i'll be getting after market stuff while i'm at it.

Nice... I guess it's nice that you get to keep your car. It's always a chore to fish out the bugs in a car you don't know. At least this time you'll know your own car.

Yea i just hope there wont be any codes to fix after words.
I'm curious why the value was as high as they put it?
I've never got GAP coverage on mine and have been a little nervous lately wondering what would happen if it was totaled. I believe KBB put me at 25k (04 with 49k miles and nearly every option).

Well it also depends on the area as well. Mine is an 03 with 38k miles, with every option but z51. maybe because he put down its a 50th aniversary?
Insurance will probably pay you out since the front wheel was ripped off the car. That's a stinking shame. Check the officer's accident report closely and make sure it is filled out accurately as to what happened before, during and after she hit your car. If you have any questions, make sure your insurance rep is aware so he can question her insurance company and make sure you get taken care of promptly and fairly. Good luck!
As an ex auto claim adjuster I totally agree!!! Sucks about your car. Hope it all works out!
