I just have a quick question. A lot of people have told me that HERE in California going over 99 is a felony. What happens if they pull you over?
AND is it true?
THANKS!!! :boxing
It depends a lot on the circumstances. Years ago CHP officers told me that a big speeding ticket - say something over 100 MPH would probably be handled as any other infraction, IF there were no other cars around. If you were passing cars in the process of traveling at triple digit speed, a wreckless driving ticket is possible and that might be a misdemeanor. In that case you better get a lawyer and try to plea it down to an infraction because a misdeamenor conviction means you have a criminal record.
If you got a big ticket you better at least go to your local library and see what the current CVC says about the violations you are charged with.

They would like it to be a felony... But that is not the case right now. If you get clocked/caught at 99+ then you are looking some big fines and possible impound depending on the PO you encounter.
Invest in a V1, keep your eyes open and be careful. If you do this then you will most likely avoid any serious problems.
I have had some personal experience in this matter, and from that, this is what I have found out.
Exceeding 100mph can be sited as a misd. but it is in the discression of the officer. Exceeding 140mph is a felony. Any of these 2 can result in an impound of the car, and jail time. This is what I understand of the matter, but am curiuous if this is in fact 100% accurate with the new laws for Ca.
I think it may have a lot to do with the officer. From what I hear, you can be arrested on the spot for speeding in excess of 100 MPH. Not that it matters to me or anything, I keep it at 55 :blueangel:
might be nice to get an attorney from California to give us the lowdown. I thought that a 20 mph over the speed limit infraction was a recipe to go to the jailhouse and post bond.
doubleing the speed limit is a felony isnt it? i know it is up here in WA
Doubling the speed limit is automatic wreckless driving. This is a class 2 misdemeanor. If they want to (since it is all subjective anyways), they can add wreckless endangerment. If they can show that you endagered anyone (including yourself) to the point of substantial risk of death, they can hit you with a class 6 felony. That means jailtime up to 1.5 years and fines up to $150,000!!

Nope - my wife got hit a couple of months ago in HerZ for 85 in a 65: ticket, traffic school, and that was it.
Here is the skinny from my experience..I am an ex cop too...but before that when I was in the military I used to race my street bike in SD. I once got a ticket for doing 100 mph over the posted speed limit..it was 1989..there was no helmet law and the speed limit was 55..so if you do the math I was doing 155 on my modded GSXR 750..the Bike got impounded, they said they were going to take me to jail for wreckless driving..which back then was anything over 85mph..but they did not cite me for that because the officers liked motorcycles and cut me a break (spirit of the law) however they could have gave me a misdemeanor..insteand I got exhibition of speed (wheelie on onramp), resisting arrest(dropped), 100 mph over speed limit, no insurance...it was a painful lesson..oh yeah and a slick rear tire..racing slick..but not street legal.
I think maybe what you could be referring too is FELONY evasion..in which you see the cops chasing you and you try to outrun them...then it is definetly a felony and you are going to jail...I pulled over when I saw the brite helicopter light...I am sure glad the cops were in a good mood, and they were on street bikes and liked fast motorcycles..it was a close one..and I have never done something that stupid again..now its on the track and deserted back roads.
Here in TX you have to double the speed limit + 10mph before they will arrest you. I got a ticket for doing 79 in a 35 and they said 1 more MPH and they would have had to take me in.
I'd say its all in the how the persuing officer sees it. For instance, about a year ago I was on my home going through Morris, AL on a curvy 2 lane road with a 25 mph limit. So of course I'm running around 85 to 90 mph :steering: (i know i know, way to fast for those small town twisties). I stop at a stop sign (not wanting to break the law or nuthin :D ) and a Morris sherrif almost runs over me as he slides to a stop behind me. To make a long story short, he had been chasing me for nearly 10 miles! :_dupe: I get cited for Reckless Driving and the judge brought it down to speeding.
So as I said, I guess its all in how the persuing officer sees it.
Mongoos
what bites is about 30 yards from that stop sign was Morris city limits and an empty highway 65 and i didnt notice it untill after he left :banghead: :cuss
It's an infraction or a misd. - no way is it a felony.
Like Shinobi, I have been cited for over 100mph on the street in Ca. (on my GSXR 1100 with the Wiseco piston kit, 38 smooth bores, Yoshimura exhaust, milled head, degreed cam, etc.)
