Default Having problems with AMS racing (Help)

Back in Febuary I got in on a group purchase for a set of Borla Stingers from AMS racing through ZOsence.
I paid in full, about a month later they told me the stingers havn't been ordered from Borla because a few people backed out of the group purchase.
So later they claim to have eventually gathered up enough people to do the purchase. Then about a month later they claim to have ordered the stingers and were sending them out to customers.
They claim mine was one of the last ones to come from the factory. Later they claim to have mailed my stingers to my house, they even gave me a UPS tracking number. But when I put the tracking number into UPS.com and I also called UPS they said that the only the billing info was recieved, and the package was not shipped out. So I launched an investigation through UPS to see if the package was lost or stolen. Later Liz from AMS told me UPS declared the package lost. After this nightmare I asked for a refund, I kept bugging AMS to give me a refund and it has been a month and they havn't given it to me. Liz at AMS said that her credit card processing company was bought out by another and they were having problem processing refunds. 2 weeks later Liz claims they processed my refund and my bank lost it. My bank has told me that she needs to provide me with some type of fund transfer documantation. She has yet to do that.
Can anyone give me some advice? Should I file suit?

How did you pay in full? If you paid by credit card, you could dispute the original charge by claiming that the company failed to deliver the goods for which you purchased. That would put the demand back on the company.

this sounds so familar that I could almost recite your story. I would suggest starting a BBB complaint, contact credit card company as possible, and litigation soon. I would also suggest contacting a site moderator and asking to have their "supporting vendor" designation revoked.

i see liz is still up to her old tricks. i had a month long battle w/ her over my stingers and she lied to me over and over . finally i got her cell # and starting calling her real early and real late. she asked me if i knew what time it was, i said it was f-----g time she came up w/ my order or my money. i contested the charges on my c.c. and ordered from l.a.p.d. YOU WILL ONLY GET SCREWED DEALINGW/ AMS RACING

like everyone said if you payed with a credit card have them to investigate, seeing that you never received your product they should refund your money,as for that bi//ch liz and her husband they should be banded from all forums,but that won't happen because they are never late paying for their forums sites,i hope you get your money back, good luck.

AMS has screwed everyone who dealt with them from all the posts that have been coming up, you are not alone. Maybe you and the other could band together and start a class action against them.

I don't undterstand their logic. Does AMS think I'm going to just forget about it! Havn't they learned from other people constantly disputing credit card purchases?

I was in on this GP and posted a "beware" message about AMS Racing, Elizabeth and Darren Melton (aka: Z0sense) back in May 2004. I tried to search the C5 Parts for Sale Archives but cannot seem to find my thread.

I too called Elizabeth 20+ times, always a story, always the run around. I even contacted Troy Roberts for assistance. Troy was nice enough to have Jim, one of the moderators send an Email to AMS on my behalf. I have to tell you, it did not help. Elizabeth even had the unmitigated gall to Email a copy of a fake credit card slip to Jim, leading him to believe that she did credit my card. THE ONLY WAY I GOT MY MONEY BACK WAS TO FILE A DISPUTE WITH MY CREDIT CARD COMPANY.

I wasted coutless hours on phone calls, Emails and threats with AMS. I will say this, if you guys want to start a class action lawsuit against this vendor, count me in. Posting a beware message on the forum was not enough, somebody has to put a stop to this BS and AMS should be banned from CorvetteForum. I did consult my attorney and the law states that no vendor should charge your credit card until the product ships. You are 100% in the right on this one. If you want to move forward with legal action, let me know. I am sure we can get plenty of forum members to join the class.

Take a look at my post under parts for sale (What to do next)It will give you all the lageal suits you can follow ,These people are inposable also put a post in LS1.com under Taxas area that seams to move the along faster because they seam to do alot of business thru that Forum.I do not know why they are allowed to advertise in Corvette Forum .It seams that anytime someone is dumb enuff to give these people a deposit they have to fight toget it back.

Again take a look at my posting it will give you some ideas how to fight them

How did you pay them ?? If by a credit card contact your CC to put this in as a dispute .Also save everyone of your e-mails with them AMS needs to be stopped

I want everyone to know that this is not my doing. I am a salesman, not a owner, etc. I do not take payment from anyone. All of you know that if you have spoken with me you get transferred straight to Liz for payment.

I said that I would not sell a single thing until all this was taken care of.

Glenn, if you will notice, there were 3 people in on the group purchase for Borla, back in Feb. That was when I started! Most of these instances I know nothing about.

In the instance of yourself and Chuck, I spoke with both of you directly on millions of occasions. I emailed you constantly, I even talked to you 2 on the phone millions of times.

I did promise you your money back out of my own pocket, in the event something were to happen. That is because differentials are my own thing...aside from AMS. I knew you would get your money back, and there was no question about it.....I do understand you are upset because it took 2 weeks, etc, but you got it back.

Do not doubt my integrity. Especially after what I did for you Glenn.

Of course I am in the middle. I sold the parts, but I do not control the funds or the goods. I was merely the sales person......how do you not understand that?

Also for the record.....I never got a 3.15 with 800 miles as a core. I received a 2.73 that was beat to hell. I will also say that you were refunded a 400.00 core, and all the shipping cost. (3 times, etc)

I have sold 30+ differentials on here alone. I have had 2 complaints and took care of both. I have never had anyone ever say anything bad about me.

Before AMS I sold parts on here as well, and never had a complaint. I have a very loyal following. I do feel bad for a couple on here that I sold parts to, I had no idea this would happen.

I can only tell you what I have been told, and that is what has been posted about the switch of merchant accounts, etc.

Also for the record Glenn.....you always received your parts....3 differentials, 3 times to be exact! For you to say anything different about me is wrong. I did tell you that you paid with a credit card and Liz would have to refund it. THere was an easy way to fix this situation and that was not to accept credit cards any longer. Instead paypal only.

You know the more I read your post Glenn, I cannot believe what I am reading.......You are more impatient then anything. I was very patient with you and did what you asked of me. For you to even doubt myself or my integrity...hurts.

Did I ever once do anything wrong against you?

I bent over backwards to help you.....that is all I have to say

Yes, I believe you can. Check the "fine print" on the back of your monthly statement. The problem with a check card is you are already out the money and need to get it back. If you dispute a charge on a credit card, that charge is "frozen" until the dispute is resolved (i.e. - you are not out the money).
