If insurance was purchased and they have a copy showing the ensured amount of the item, then the UPS store has no choice but to honor the insurance agreement. This is especially true if the item was packaged at the UPS store. I would not back off on this, especially if the seller has a copy of the shipping paper work and proof insurance was purchased. This is a slam dunk in court with paper work in hand.
We have had problems with UPS and their first stand is always.. "it was packaged improperly".
We have settled all claims with them by going to higher levels.
But as a result we now ship 95% Fed EX.
They(FedEx) does not loose parts, boxes etc.
You do have recourse...
A threat of a law suit generally gets their attention..
Have your attorney write the letter on his letter head..
That should get you a proper response..
I have been a commercial UPS/FedEx/USPS shipper for years. All of them are "self-insured", just like common carriers.
AND, I have never ever had a problem with a claim, especially with UPS!
I have also shipped several Corvette tops. But trying to be smarter than the average bear, I built a plywood box about yea" X yea" to securely hold the tops. Shipped them over 2,000 miles with ZERO problems. None. So what is an extra ten bucks for the weight of the wood....damn well did it's job! HINT: wrap them in an old bed spread and styrofoam the edges....
My office is down a half-flight of stairs.
I regularly receive heavy boxes of catalogs and books.
I caught my UPS driver pushing my deliveries down the steps.
After that, I ship FedEx ground where the driver is a small businessman, not a teamster.
I am convinced that anything can be shipped, and can arrive in perfect condition. The key is in how it's packed. I would NEVER have one of these ups stores pack anything that I ship out. If you want it done right, then you have to do it yourself. Some of these stores are notorious for putting a 24" piece in a 24 1/2" box and this will not give corners enough room for plenty of bubble wrap and protection. Another mistake people make is using the packing peanuts to pack stuff. You should almost always use bubble wrap and plenty of it.
When I do a google search, UPS has as many consumer complaints for claim denials as XM radio has for dishonest billing practices.
This has happened enough times with Corvette tops that I would never ship or receive a top that wasn't packaged inside a plywood box. But if you read the threads below, UPS even managed to break a guy's top that was in a wooden box.
UPS sucks at certain things great on others. Example I bought a new C6 and wanted a glass roof for a trip. They had many with the roof and took one from another C6. They ordered from GM 2 roofs both came in broken. They again ordered 2 roofs again broken all on one corner. The packing was OEM from GM with corner insert packing.
".....snipped.....A friend is a licensed firearms dealer, he walked out his door one night to find a shotgun box that had been sitting there for a day or two, "Adult Signature Required".
Incredible!

I've never had any problems with UPS but fortunately I've never had to file a claim either. If you only had to pay an "extra ten bucks for the weight of the wood" that's good. Over the past several months I shipped two items that were roughly the same weight. One box, however, was slightly larger and the difference in price was over $60.00. UPS said, due to the box dimensions I had to pay for shipping 56 lbs even though my shipment weighed 22 lbs. That didn't seem right.

I have always been told by everyone thats in the same business I'm in: "If you want it to arrive in one piece, dont ship it by UPS" They seem to break everything. I never use them. plus deliveries take forever!
i think it varies from town to town. we have a good hub here, they are always on time, and have delivered all of the packages in good shape for a couple years now. I think it helps that I always get to know the driver, because he invariably stops to chat about vettes and Barrett rifles when he drops off a pair of 345s, a Halltech box, and 20 cans of API and APIT .50BMG ammo.
i only "ship" papers with ups anymore. lost a ton of money a few years back with an engine that was crated and shipped by them. it came damaged. took them forever to send a claims agent. then i never heard another word from them because they stated that i was not the insurer, the shipper was the insured so i didn't have the right to any claim information or payment. i never found out if the shipper ever received the insurance. their insurance policy is akin to a contract with a real estate developer - everything is weighted on their side. live and learn. i still have that damaged engine to remind me NOT TO SHIP ANYTHING THAT I VALUE WITH THEM AGAIN. that's my story and i'm stick'n to it. this is your brain. this is your brain on ups. any questions?

I received a response with satisfactory results after filing a BBB complaint for a similar issue a few years ago. It only costs the time to file the complaint on-line.
Recently purchased a brand new glass top from a Forum Member. The seller had UPS ship the top(insured) in its original box from(with the original packing from GM) and asked the shipper to put more packing in just to make sure and paid extra for it. The top arrived here to me damaged. The seller filed a claim with UPS, an inspector came out and examined the top at the buyers residence and agreed, that yes it was damaged. Now, UPS will not honor the Claim on the Insurance that the seller placed on the top! UPS claims it was not packed correctly.....???
So, before you ship something as expensive as a Glass Top, better find an alternative method...

I just sent you a PM regarding this. You are vright UPS is very hard to deal with, as a matter of fact they will not even give you the name of theiir insurance CO.
They do have a outside company that does handle claims but do not make that known.
I had a claim with them last year for $400.00 AND THEY FOUGHT ME to the end not to pay, do to their guide lines. BullSH$#... I hammered them and they ended up paying.
So to all my Corvette buddys out there who need to know who their Insurance Company is.. CRAWFORD INSURANCE
I hope this will help everyone who has been wronged by the wonder brown company.
My company sells industrial wheels/tires and ships UPS on a daily basis. A few years back they managed to bend the lip on a HD steel wheel and told me they wouldn't pay for the damage as it was improperly packaged.
I gave them a demonstration of how tough the wheel was by dropping it off the mezzanine(about ten feet) with no damage done, but they still said they couldn't help me. I calmly told them that that was fine,if this was how they treat loyal customers that I would have to explore other shipping options for my small packages. Then, and only then, did they agree to pay.
So yeah,I know exactly where you're coming from with those jerks.Good luck.....
same thing happened to me when i shipped some speakers i sold on this forum. they were in perfect shape, i packaged them as they came from the factory and took them to the UPS store. the guy said it wasnt packaged very well, so he would add some peanuts to the inside and wrap it better, i said THANKS!! of course i got the insurance anyway. the guy gets the speakers , there was no extra packing and they ended up all banged up. needless to say, i got the **** from the buyer. as a seller, what could i do? i cant just refund him for UPS's mistake. all i could tell him was to file an insurance claim, but i did give him like $10 back just cause.
