I think people are misinterpreting this picture. First, on the right side of the flap you can see the rest of the cover has been folded in front of the flap. Normally this is attached to the hatch, and when open, the seats are not visible - like this:
It looks like the tie-down hooks are being used to secure the bottom of the flap. A lot of people were annoyed with this thing flapping around. The tie-down hooks fold flush with the floor when not in use.
