This just in… AG Madigan’s en banc motion denied
the full Seventh US Circuit Court of Appeals has denied Attorney General Lisa Madigan’s request for an en banc hearing of the recent ruling by a three-judge panel that Illinois’ public gun carrying laws are unconstitutional. Madigan wanted all of the appellate judges to hear the case. Not gonna happen.

Below is an update on some of the hot button issues facing Illinois and our district.
Early Release
Gov. Quinn announces startup of early release program. Under a new State law enacted in 2012, prisoners may be awarded up to 180 days of controversial Supplemental Sentence Credit based upon what the prison system determines to be good conduct, and may be released early after cashing in the credit days awarded under this program. Eligible inmates include inmates that enroll in, and successfully complete, a job-training program or a substance abuse rehabilitation program. Ineligible inmates include inmates convicted of certain violent criminal offenses, or who commit further offenses when in prison or on parole. Although Gov. Quinn told the press on Wednesday, February 20 that the program was starting up “right now,” other sources stated this week that the files of potentially eligible inmates continue to pass through an office review process and no inmates have actually been released yet. Other reporters have discovered that overcrowding in Illinois prisons has become so serious that wardens of several Illinois prisons have been forced to take steps to bunk down some of their inmates in converted athletic rooms and gymnasium space.

House of Representative holds hearings on implementing Second Amendment “concealed carry” law in Illinois. The first hearing, held in Springfield on Tuesday, February 19, drew testimony from the Illinois State Police, the agency that would design and run a future concealed carry permit system, as well as the National Rifle Association and other interested parties. The State Police told the House Judiciary Committee that the cost of operating a concealed carry permit system, which would be passed on to permit applicants, could be as much as $242 per permit. A federal appellate decision by the Seventh U.S. Circuit Court of Appeals directed the General Assembly to enact a “concealed carry” law by May 31, 2013.
Should no law be enacted, an undetermined number of Illinois’ existing gun-control and gun-violence laws, including some criminal laws, would be struck down. On Friday, February 22nd, the full Seventh Circuit Court of Appeals denied Attorney General Lisa Madigan’s request for an “en banc” hearing of the recent three-judge panel’s ruling that Illinois’ ban on concealed carry is unconstitutional. State lawmakers are under serious pressure to join the other 49 states that have enacted laws to enable local residents and citizens to carry concealed handguns on public ways, such as streets, highways, and sidewalks.
