A spokeswoman for Gov. Pat Quinn said the administration is reviewing the decision. The governor has previously said he was firmly opposed to any law allowing citizens to carry loaded guns in public. He threatened to veto previous attempts by lawmakers to pass legislation allowing concealed carry in Illinois.
Mayor Rahm Emanuel said through a spokesman that he was “disappointed with the court’s decision.” The city is reviewing the opinion and will work with others “to best protect the residents of Chicago and still meet constitutional restrictions,” Bill McCaffrey added.
“As the mayor has said all along, the City of Chicago is committed to maintaining the fullest degree of lawful handgun restrictions possible while still respecting the Second Amendment rights of law abiding citizens, because maintaining common-sense restrictions is an issue of public safety.”

The ISRA is warning gun control advocates in the Illinois General Assembly against trying to hijack today's ruling by the 7th Circuit Court of Appeals regarding the carrying of defensive firearms.
In making that ruling, the court struck down Illinois' prohibition against co-called "concealed carry" as being afoul of the 2nd Amendment and, therefore, unconstitutional. The court has given the state 180 days to provide relief to citizens who wish to carry defensive firearms.
The ISRA is fully aware that some members of the general assembly will attempt to thwart the intent of the court's ruling by introducing concealed carry bills that contain provisions so strict that few, if any, citizens would actually qualify for a permit. Still other members of the general assembly will see this ruling as an opportunity to tack gun taxes, gun bans and other unacceptable forms of gun control onto the court-ordered concealed carry legislation.
The ISRA warns such legislators that attempts to undermine the court's intentions could result in renewed litigation."The notion of concealed carry is something new to many Illinoisans," said ISRA Executive Director, Richard Pearson. "I can understand the apprehension some feel about people carrying defensive firearms in public. If they have heard some of the misinformation about concealed carry that I have heard, then that apprehension would come naturally.
However, the truth of the matter is, studies consistently show that concealed carry has purely positive impacts on public safety.""Public safety is the ISRA's number one concern," continued Pearson. "That is why we helped craft HB148, the Family and Personal Protection Act. In creating the bill, the ISRA drew upon the experiences of other states that had already enacted concealed carry.
In the end, we are confident that HB148 more than addresses public safety concerns while providing citizens with a practical means of defending themselves against violent crime. "At the moment, HB148 is bottled up in legislative limbo," said Pearson. "But, we expect that the court ruling will shake HB148 free and that the bill will be voted on soon.

SPRINGFIELD - In a huge win for gun-rights groups, a divided federal appeals court in Chicago Tuesday tossed the state's ban on carrying concealed weapons and gave Illinois' Legislature 180 days to craft a law legalizing concealed carry.
"The debate is over. We won. And there will be a statewide carry law in 2013," said Todd Vandermyde, a lobbyist for the National Rifle Association.
In a split opinion (see below), the 7th Circuit Court of Appeals reversed a lower court ruling in two cases downstate that upheld the state's longstanding prohibition against carrying concealed weapons.
Illinois is the only state with an outright prohibition on concealed carry.

"We are disinclined to engage in another round of historical analysis to determine whether eighteenth-century America understood the Second Amendment to include a right to bear guns outside the home," Judge Richard Posner wrote in the court's majority opinion.
"The Supreme Court has decided that the amendment confers a right to bear arms for self-defense, which is as important outside the home as inside. The theoretical and empirical evidence (which overall is inconclusive) is consistent with concluding that a right to carry firearms in public may promote self-defense," he continued.
"Illinois had to provide us with more than merely a rational basis for believing that its uniquely sweeping ban is justified by an increase in public safety. It has failed to meet this burden," Posner wrote.
"The Supreme Court's interpretation of the Second Amendment therefore compels us to reverse the decisions in the two cases before us and remand them to their respective district courts for the entry of declarations of unconstitutionality and permanent injunctions," he continued.
"Nevertheless we order our mandate stayed for 180 days to allow the Illinois legislature to craft a new gun law that will impose reasonable limitations, consistent with the public safety and the Second Amendment as interpreted in this opinion, on the carrying of guns in public," Posner said.
In a minority opinion, Judge Ann Williams wrote that Illinois is within its rights to ban weapons in "sensitive places" like government buildings, churches and universities in the name of safety.
"The Illinois legislature reasonably concluded that if people are allowed to carry guns in public, the number of guns carried in public will increase, and the risk of firearms-related injury or death in public will increase as well," Williams said. "And it is also common sense that the danger is a great one; firearms are lethal."
Attorney General Lisa Madigan, who was defending the state's prohibition of concealed carry, remained silent on whether her office would appeal Tuesday's ruling to the U.S. Supreme Court.
"The court gave 180 days before its decision will be returned to the lower court to be implemented. That time period allows our office to review what legal steps can be taken and enables the Legislature to consider whether it wants to take action," Madigan spokeswoman Maura Possley said.
In May 2011, gun-rights advocates lost a bid in the Illinois House to legalize concealed carry by a 65-32 vote. Seventy-one votes were necessary for passage of the legislation, House Bill 148, which was lobbied against by Gov. Pat Quinn and Chicago Mayor Rahm Emanuel.
The measure, sponsored by state Rep. Brandon Phelps (D-Harrisburg), would have enabled Illinoisans to carry concealed weapons if they had a firearm owner's identification card and underwent a firearms education course.
Under the failed bill, permit holders could not have been a patient in a mental institution in the previous five years nor have any felony, violent misdemeanor or drug convictions in the previous 10 years.
Concealed weapons also wouldn't have been allowed under the plan at government buildings, courthouses, schools, sports arenas and stadiums, amusement parks, libraries or college campuses.
At the time of the vote, the Illinois State Police estimated that 325,000 people would taken advantage of a concealed-carry program, which was projected to raise $32 million annually for the state through license fees.
Phelps would not rule out possibly trying to move concealed carry legislation during the upcoming lame-duck legislative session, which runs from Jan. 2 through mid-day on Jan. 9. But he stopped short of saying how closely a new bill would mimic HB148.
"In that bill, there were a lot of limitations, a lot of safety guidelines, background checks. But pretty much, this court today didn't really specify where you can carry, where you can't. It just sent a mandate that Illinois has to have a concealed carry law in 180 days," he told the Chicago Sun-Times. "I think we can come to an agreement. I think we can pass sensible legislation."
Whatever form the legislation takes, Phelps said he thinks it will have a noticeable impact on Chicago's crime epidemic.
"There are a lot of people in the city of Chicago who are scared to say if they are for concealed carry. I had numerous people email and call me from Chicago and Cook County who said they wanted this day to happen -- people who couldn't say something, but maybe worked for the city or county," Phelps said.
"I think you'll see a reduction in violence because right now, the criminals know there's no one legally who can defend themselves. If I'm a gang member and I now know there's concealed carry, if I try to steal that person's bag, I'll be careful what I do because that person might have a gun."
The governor's office, meanwhile, played its cards close to the vest after Tuesday's ruling but noted Quinn's opposition to the earlier Phelps legislation.
"His opposition then stands for itself," Quinn spokeswoman Brooke Anderson said, referring to her boss. "But we're reviewing the opinion now to determine our next step."
A spokesman for House Speaker Michael Madigan (D-Chicago) said he had not conferred with the top House Democrat on a possible course of action following the ruling, but an aide to Senate President John Cullerton (D-Chicago) hinted at a lengthy legislative response time that could well go beyond the first two weeks of January.
"We're going to take the time the court has given us to carefully review the ruling and to consult with the attorney general's office before we determine what legislative action we take on concealed carry," Cullerton spokeswoman Rikeesha Phelon said.
The head of the state's primary gun-control group disagreed with the appeals court ruling and urged Illinois lawmakers to write "the most restrictive requirements" possible akin to tight concealed-carry laws in New York and California, which control who can and can't get a permit to carry a weapon.
"Today's decision is disappointing, but not surprising, said Colleen Daley, executive director of the Illinois Council Against Handgun Violence, in a prepared statement. "The strategy of the NRA and the gun-rights organizations has been to litigate where they can't legislate."
But Vandermyde, the NRA lobbyist, cautioned that gun-rights advocates won't allow the legislative process to drag on indefinitely, and certainly not past the 180-day window established by the appeals panel.
"I can tell you right now, we'll look very dimly about people dragging their feet to sit here and say we're going to let the governor play his little game ... to drag it out for another year. If that happens, there's the probability we'll be back in court, seeking an injunction immediately. There's a cliff to this thing," Vandermyde told the Sun-Times. "You know what? We waited 20 years for this. We're tired of waiting."

Like all people of good conscience Illinois’ 1.5 million law-abiding firearm owners are shocked and saddened by the crime that took place recently in Newtown, Connecticut. The families of the victims are certainly in our thoughts as they work through the anguish that accompanies the sudden and violent loss of a loved one.
The heartfelt compassion we feel for the victims of this crime is matched only by the deep disdain we feel for Governor Pat Quinn, Mayor Rahm Emanuel, Mayor Michael Bloomberg and the rest of the political opportunists who have swooped down on Newtown like a flock of vultures hungry to devour the 2nd Amendment.
The echoes of the sirens had hardly faded when Quinn and other gun control extremists hit the airwaves calling for the passage of legislation that would effectively abolish the 2nd Amendment to our Constitution. Law-abiding gun owners have grown used to being blamed for the misdeeds of others and we’re equally used to mounting effective defenses against those who would deny us our rights.
In the hours since the horror, we’ve learned a lot about the Newtown killer – with sadly familiar patterns emerging. As has been seen in mass shootings dating way back to Laurie Dann, the Newtown killer was apparently a mentally ill young person whose wealthy family insulated him from reality until he decided to create his own reality – at the expense of more than two dozen innocent people.
As more facts in the case come to light, we also see a familiar pattern of warning signs leading up to the murders. It has been reported that the Newtown killer left telltale messages on social media sites and had been involved in a heated altercation at the doomed school only days before. Furthermore, we learn now that, in the week before the murders, the killer had attempted to purchase a rifle but the sale was denied because he could not pass a background check.
In this case, it may be said that gun control “worked.” Denied legal access to firearms, the deranged killer murdered a legal firearm owner, stole several of the victim’s guns, and exacted his idea of revenge against nearly 30 innocent people. The pieces of the equation that did not work were the social institutions that are supposed to prevent mentally ill individuals from becoming a menace to themselves and others.
Of course, the gun control movement is trying to sell the notion that the Newtown crimes somehow share a direct link to the free exercise of 2nd Amendment rights. The gun controllers would have the public believe that the killer was just a typical “gun guy” and that every gun owner represents a spree killing just waiting to happen.
Such is the logic that will fuel the gun control movement’s latest onslaught against your gun rights. As you read this message, gun-grabbers like Pat Quinn, Rahm Emanuel, and Michael Bloomberg are formulating legislation that would result in the banning and confiscation of nearly every firearm you own.
In the days and weeks ahead, you will hear a lot of talk about the need for a dialog on so called “gun violence” as well as a need for compromise to seek common ground on gun ownership. Don’t be confused. Such talk is just meant to soften you up for a serious curtailment of your right to keep and bear arms.
You, the law-abiding Illinois firearm owner, may rest assured that the Illinois State Rifle Association will be standing firm to preserve and protect your gun rights. We absolutely will not allow you to be lumped in with psychopathic murderers. The ISRA will not allow you to take it on the chin because liberal social engineers have created a climate where we are expected to learn to live with sociopaths rather than forcing the sociopaths to live by our rules.
Likewise, the ISRA will not engage in any “dialog” in which lawful firearm owners are expected to accept blame for what happened last week in Connecticut. We will not be party to any sort of “compromise” that limits free exercise of your 2nd Amendment rights nor limits the types or numbers of firearms that you may own. At this time, the only thing we’re really interested in discussing is the immediate passage of concealed carry in Illinois as per the recent court order.
The Connecticut murders have delivered an insult to our nation’s sensibilities and our culture. In the aftermath of such events, people seek explanations for things that cannot be understood by rational individuals. Sadly, politicians are eager to step in and fill the void – offering solutions that promise little more than a boost to the politician’s career.
It’s easy for politicians like Governor Pat Quinn to stand up and pound the lectern while calling for the ban and confiscation of semi-automatic firearms. But Quinn and his ilk would do well to remember that there are about 1.5 million firearm owners in Illinois. Of that 1.5 million, most own one or more firearms that would be banned under the knee-jerk proposals being floated post-Newtown. Enactment and attempted enforcement of such a gun ban would serve only to divide a divided nation even further. The cost of enforcement would be enormous in terms of resources and unintended consequences. The nation must ask itself just what price it is willing to pay to attempt enforcement of laws that do nothing more than give politicians a moment in the limelight.
If ever there was a moment where law-abiding gun owners need to get involved to preserve and protect their rights, it is now. The ISRA is urging all Illinois firearm owners to contact their state representatives and state senators and deliver the message that lawful firearm owners will not play the role of scapegoat and thus will not sit idly by while their rights are being curtailed. Remind them that their job is to protect the fabric of society, not the moths that would seek to destroy it. I am nothing of the kind. I don't have a problem with lawful owners, who know how to use them, keep them safely away from those who shouldn't have them, and exercise the correct judgment if they use them.
However, I take issue with the politicians "swooping" in etc to take advantage as mentioned. It seems every 4-6 weeks one of these events happens, and if they had wanted to do so there are numerous previous opportunities for them to have done so in the past year alone. They didn't. Maybe that's election politics, maybe it isn't.
Just today we heard of another Indiana individual with 47 guns who threatened a school. As a reasonable person, I first ask...if he IS mentally ill, how did he get 47 guns! If he is sane, what the hell do you need 47 for!
Clearly SOMETHING needs to change. As an enlightened people, we simply cannot allow this to continue.
The premise of your post suggests that 1) the current system worked (so leave it alone); and 2) the anti-2nd amendment folks will use this event as an argument to remove your rights completely.
I would suggest to you that since the apparently mentally ill shooters in the Cinema in Aurora CO, the temple in Wisconsin, and the recent West Coast Mall shooter all had issues and STILL had access to guns...it isn’t working so great. The description of "Mental Illness" is also an issue. The guy in the Wisconsin temple didn't appear to have any such illness, besides the stupidity of being a backwater redneck/skinhead with an inability to understand that killings Sikhs is not the same as killing Muslim extremists.
There are also plenty of FBI and law enforcement statistics about the number of guns on the street being stolen from lawful owners being used in crimes, or their kids taking them to school or hurting/killing themselves or others (accidentally or otherwise). Missing from the post is that the "lawful gun owner" that owned the guns in the most recent Newtown killing was the shooter's mother...the woman you disparage as insulating the shooter and not deaing with him properly. The ISRA post at least implies that the shooter stole them from a unrelated party, else, why not just state the facts? Because the facts don't help ISRA's goals. ISRA can't contemporaneously hold up the mother as the model lawful gun owner on one side, a victim of theft that additional laws would not protect against, and holding all the rights you espose for similarly situated owners, and disparage her as a bad mother and a potential cuase of this tragedy.
Women are statistically several times more likely to be killed in a domestic dispute where a gun is present in a home.
I could continue, but I know facts and figures mean little to a lot of people. I'm sure there will be other facts that could be thrown out there about the guy who but for access to his armory, would have lost his life or not been able to shoot the intruder....etc. But those fact debates are unnecessary anyway...it's the 2nd Amendment Damn It!
Guys....honestly....do you truly believe that ALL our constitutional rights are without limit or exception of any kind!? The Constitution is PERFECT?
If you do, you need to read up on the law, and history. It's a cliché, but you can't yell fire in a crowded theater! You can't incite people to violence. You can't defame or invade privacy. Why? Freedom of Speech in the First Amendment does not trump public safety or other private rights in that regard. Now, none of these things are listed as exceptions in the First Amendment.
Fourth Amendment protections as to search and seizure have been carefully scrutinized over the past decades, and many things are not considered violative of those protections due to process or technology never envisioned by the founding fathers. Again, these things are not listed as exceptions in the Fourth Amendment.
Again, I could go on. As a people, as we grow, technology adds challenges, or takes them away, we evolve ways we run our laws and society. Why is the 2nd Amendment SO sacrosanct if other clearly more important rights to the maintenance of our liberty have now time tested and overwhelmingly accepted viewpoints and exceptions (limited as they may be in certain cases)? Do you HONESTLY believe that the founding fathers envisioned you being able to buy the firepower you can today and what it can do in a few seconds? Like many others, I find the traditional "Guns don't kill people..." arguments and other patriotic laden rhetoric about "protecting law abiding gun owners" tired and out of date.
I just came back from the UK/Europe and business meetings today, and I was asked a lot of questions about our policy in light of the latest tragedy. I really tried to give an impartial viewpoint of both sides of the issue. They still didn't understand why someone needs a military style weapon with a huge clip...or why we can't allow hunters and sport shooters their rights while we protect others, or why we don't have mandatory training for gun owners but you have to take a test to drive a car, or why someone needs 20 different handguns for "self protection", and other issues.
I didn't have any good answers for them, because these are questions I share. I’m not after your rights….I’m after a solution. Doing nothing is not the answer, and not acknowledging the reality of history, sociey, the Constitution, and changes in weapon technology is simplistic and intellectually dishonest.

Bob, you have done a great job with this thread and those who support the 2nd amendment like myself, must do what we can to preserve our rights, and defend ourselfs from the mentally deranged, suicdal, murderous whack jobs, who are now committing these crimes on a daily/weekly basis. These acts of domestic terrorism are now unfortunately a national epedimic in our broken Country/World, and unfortunatly things are just going to get worse, and there will be more and more copycats, and more innocent victims will be killed, if the liberals have there way, and take away the rights of, normal, mentally stable, law abiding citizens, while the mentally insane, phycotic murderers, could give a rats azz about any gun laws, as they plan and execute their next tragic, Evil, attack.

All I wish for is the ability to protect myself, family and loved ones from those who no longer have respect for life. I am at a point that I would gladly put myself in harm’s way to prevent such tragedy.
EVERYTHING I do follows the letter of the law! Politicians and Judges have us at their mercy and can change or create law at their whim. They only care to keep their positions or even stricter laws would already be in place.

Do I think laws will be enacted outlawing all new sales of Military Sytle Weapons and those magazines that have a capacity of more than 10, yes, that is going to happen for sure, now that this Country is truely falling apart, and these despicable act of evil are now becomming a daily occurrence.

(Reuters) - U.S. private equity firm Cerberus Capital Management said on Tuesday it will immediately begin selling its investment in gunmaker Freedom Group in light of last week's school shooting in Connecticut.
Cerberus acquired Bushmaster in 2006 and later merged it with other gun companies to create Freedom Group, which reported net sales of $677.3 million for the nine months ending September 2012, up from $564.6 million in the same period a year ago.
Bushmaster is the manufacturer of the AR 15 rifle used by the shooter in the Newtown killings that claimed 27 lives, including 20 school children.
"We do not believe that Freedom Group or any single company or individual can prevent senseless violence or the illegal use or procurement of firearms and ammunition," Cerberus said in a statement.
The private equity firm said it will retain a financial adviser to sell its interests in Freedom Group, and will then return that capital to investors.
Pressure mounted on Cerberus as the California State Teachers' Retirement System (CalSTRS) said on Monday it was reviewing its investment with the private equity firm in light of the Connecticut school shooting.

But director of ultra-violent film Django Unchained went ahead with a press junket on Saturday, and went on to remark that he is tired of defending his films every time America is rocked by gun violence.
Speaking in New York Quentin Tarantino said: “I just think you know there's violence in the world, tragedies happen, blame the playmakers. It's a western. Give me a break."

KEARNS, Utah — Authorities say a Utah sixth-grader caught with a gun at school told administrators he brought the weapon to defend himself in case of an attack similar to the mass shooting last week in Newtown, Conn.
The Salt Lake Tribune reports that two classmates at West Kearns Elementary School reported the gun to a teacher toward the end of the school day Monday.
Granite School District spokesman Ben Horsley says the teacher "immediately apprehended the student," and police responded shortly after.
Horsley tells KSL-TV that an unloaded gun and ammunition were found in the 11-year-old's backpack. Authorities have not released the child's name.
Horsley says school police are investing reports that the boy pointed the gun at another child's head. He says such accounts haven't been confirmed.
Authorities say no one was injured.

"So went to Gat Guns for the first time Tuesday, it was packed, thought it was kind of odd for a Tuesday night. There was a long line of about 100 people upstairs, I wasn't sure what it was for at first but it was people picking up gun purchases. I talked to one employee that stated the owner told him it is the busiest the store has been since the '68 riots, busier then when the Clinton ban was being enacted, busier than either time Obama was elected. I was there for 2 hours and the line did not shrink at all.
As I browsed the sales floor it was clear there were way more people looking to buy guns then there were employees to sell them. I went by the AR15 style rifle section and there were about a dozen people looking to buy and 1 guy working. One customer was getting frustrated because they didn't have the model he wanted and the clerk said "Sir I'm sorry but we have sold more ARs in the last 3 days than we have ever sold in in any 3 day period since I have been working here, what we have on display is all we have left there is no back stock." They had about 10 AR15 styled rifles left and they appeared to be some oddball models. Same story by the semi-autos. A customer was looking for a specific model of XDM I believe and the clerk said "I'm sorry but we don't have any back stock, every gun we have is out on display. Normally we have at least 5 of each gun we have on display in the back but we only have whats on display" The clerk said it was the first time he had seen that happen."
President Barack Obama will on Wednesday announce the first step on gun control following the Newtown school shootings: an interagency task force, led by Vice President Joe Biden, charged with guiding the administration’s continuing response.





Things are ABSOLUTELY crazy out there right now with gun sales on FIRE, and will continue to be all the way up until the new laws that ban new sales of assault style weapons, and mags that hold more than 30 rounds, kick into effect in the near future, and you know that's coming down the pipe.
Of course those laws will have 0 positive effect on these horrific tragedies, and the laws continuing to violate the 2nd amendment rights of the abiding citizen, creating and maintaining more gun free zones, will only lead th slaughter of more innocent people in the future, as these domestic acts of terrorism are going to continue to happen very ofen in our country that is broken, its now a weekly occurrence, thanks to the liberals in this Country who have ruined this great Country of ours!
