if you have good insurance (agreed value) him not having any insurance can work to your favor... your insurance will cover the damage and it will not go on your record or jack your rates... or at least that's how it worked out for the hot young stripper wife when she was rear ended and totalled a car last year... Unfortunately in Texas you can't sue someone for more than their insurance will cover. I've been through it twice with 2 different lawyers, and one was with an uninsured motorist. The best you can hope for is for your own insurance to cover what you have on your own policy. Anything other than that just simply isn't going to happen. My insurance company has been trying for years to recoup my deductible with no luck. This is exactly why I changed my own coverage to the max my insurance company would cover me for.

Really sucks for you. I had a guy road rage and literally ram his car into mine. When the cops got there he claimed I turned into him. Thankfully a motorist that was behind me stayed to talk to the police & this guy ended up with multiple tickets including one for road rage. Still he tried to claim to his insurance that I hit him & that the motorist who stopped to talk to the police & I were in it together. In the end I had to wait until his insurance company received the police report stating he was at fault and his multiple tickets so the resolution took awhile.
In New York where I lived for most of my life if you didn't have insurance the car couldn't be registered. If you let it lapse the registration was suspended and the fines were quite steep, eventually your license
would be suspended if you didn't get insurance. In Georgia I have uninsured motorist coverage. Sorry for your misfortune.

Insurance laws are very similar in Georgia to what you experienced in New York.
Time to hire an attorney to go after him civilly even though he probably doesn't have much but will have an unpaid judgement against him for ever.
I think it would have been much more satisfying to drag his *** out of his car and beat the crap out of him. Regarding his lying BS, that's why I've installed two dashcams so far in my DD and the C6. I plan on getting one for each vehicle.

Is there a law in Texas that allows you to put a hold on is drivers lic's, it does not mean he wont' drive but if the police are involved again he could go to jail, Get a lawyer !!!
