16% pay raises? .. nice we can help those hard working politicians and the few hours a year they work.. could you imagine at your job how you would be ecstatic you would be to get a 1% raise? Maybe they need that money for private security and help hiding from "the people"...

Well, it passed senate. Moves back to the house where it will surely pass and go to Prickskers desk. If there’s anything y’all ever wanted to buy tomorrow morning is the time with the grandfather clause in the current language. “We’ll see you in court”.

UPDATE – Illinois Bait & Switch – Insurance Code-Public Adjusters Bill Morphed Into Gun Ban Bill. Governor J.B. Pritzker signed an assault weapons ban into law Tuesday night, hours after the Illinois House passed it in Springfield.

The legislation bans the manufacture or possession of dozens of brands and types of rapid-fire rifles and pistols, .50-caliber guns and some attachments. The law will allow gun owners to keep the guns they have now, but will require them to register them with the state.

Illinois gun manufacturers can continue to make assault weapons and sell them to suppliers in other states, but may not sell them to buyers in Illinois under the new proposal.

The bill will still allow people to keep the banned weapons on their private property.

If police stop a car driven by a semiautomatic gun owner, they can instantly check to ensure its legally owned. Also, it allows law enforcement to trace a gun that, for example, is stolen and used in a crime.

An "assault weapon" is defined in the new proposal means any of the following:

A semiautomatic rifle that has the capacity to accept a detachable magazine or that may be readily modified to accept a detachable magazine, if the firearm has one or more of the following:
a pistol grip or thumbhole stock;
any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
a folding, telescoping, thumbhole, or detachable stock, or a stock that is otherwise foldable or adjustable in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability of, the weapon;
a flash suppressor;
a grenade launcher;
a shroud attached to the barrel or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel.
A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.
A semiautomatic pistol that has the capacity to accept a detachable magazine or that may be readily modified to accept a detachable magazine, if the firearm has one or more of the following:
a threaded barrel;
a second pistol grip or another feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
a shroud attached to the barrel or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel;
a flash suppressor;
the capacity to accept a detachable magazine at some location outside of the pistol grip; or
a buffer tube, arm brace, or other part that protrudes horizontally behind the pistol grip and is designed or redesigned to allow or facilitate a firearm to be fired from the shoulder.
A semiautomatic pistol that has a fixed magazine with the capacity to accept more than 15 rounds.
Any shotgun with a revolving cylinder.
A semiautomatic shotgun that has one or more of the following:
a pistol grip or thumbhole stock;
any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
a folding or thumbhole stock;
a grenade launcher;
a fixed magazine with the capacity of more than 5 rounds; or
the capacity to accept a detachable magazine.
Any semiautomatic firearm that has the capacity to accept a belt ammunition feeding device.
Any firearm that has been modified to be operable as an assault weapon as defined in this Section.
Any part or combination of parts designed or intended to convert a firearm into an assault weapon, including any combination of parts from which an assault weapon may be readily assembled if those parts are in the possession or under the control of the same person.

The Day After HB5471

What You Need to Know

Members of Aurora Sportsmen’s Club. Do not lose heart, do not lose faith, do not despair.
F I G H T
I know you’ve heard by now that the governor signed HB5471, the Illinois law that should be called the “Make the Most Law Abiding Citizens in Illinois into Felons act of 2023.” I’m going to walk you through the major impacts as we understand them today and then tell you what we are doing about it and the timeline for action.



Items that are banned from sale, purchase, or transfer effective immediately (January 11, 2023) are:
  • Semi-Automatic Rifles with detachable magazines or folding/telescoping stocks
  • Rifle Magazines over 10 Rounds
    • Possession of rifle magazines over ten rounds is prohibited 90 days from the act's signing; magazines owned before January 11, 2023, are grandfathered.
  • Pistol Magazines over 15 Rounds
    • Possession of pistol magazines over fifteen rounds is prohibited 90 days from the act's signing; magazines owned before January 11, 2023, are grandfathered.
  • Certain Shotguns
  • Certain Handguns “Assault Handguns” in the law.
  • 50BMG Firearms
  • 50BMG Ammunition
  • Any part or combination of parts that can be used to turn a firearm into a prohibited “Assault Weapon” (Long definition in the law itself)


What do I need to do right now?



For now, the only items you need to do to protect yourself are not to perform any transfers of prohibited items under this law. Additionally, if you are transporting magazines over the limits listed above, they must be unloaded and, in a case, not immediately accessible.



One of the shocking pieces of this legislation is how the legislature came after turkey hunters. Typically hunting shotguns have been exempted from gun bans in other states and prior versions of proposed legislation in Illinois, but not this time.

If our TRO and preliminary injunction are unsuccessful, registration for grandfathered firearms would begin in early October (300 days after the bill’s effective date) and continue for 90 days, at which point registration would close. All unregistered firearms will be considered contraband. With a successful TRO and preliminary injunction, all transfers and other restrictions would revert to pre-January 11th status until the case's conclusion. We will notify you whichever way those motions break. We believe we have a high likelihood of prevailing on the motions.

Your ability to use ALL firearms and magazines that have been allowed at ASC continues to be legal and encouraged at the club. Make sure you are transporting guns and magazines in a way that does not put you in jeopardy with the state, but know that ASC is not going to police the items an individual owns, possesses, or uses at the club.



What is ASC doing about it?



I hope you have heard by now that we plan to initiate a lawsuit in partnership with the FFL-IL organization that represents the firearms retailers in Illinois. GSL will also be assisting us in our efforts. We continue to seek partners to assist us in our battle and will announce any as they come on-board. We will be combining forces with them and sharing the expenses of what will be an expensive endeavor. If you have a potential large donor, please steer them to Todd or me.



We have retained the law firm of Shaw Law Ltd., sometimes referred to as Shaw and Danforth, as our local counsel. Additionally, we are enlisting Michel and Associates and the 2nd Amendment Law Center from California. They are currently responsible for several gun cases pending before Judge Benitez in California. Both firms have impressive credentials in Second Amendment cases. We have confidence in their ability to write compelling complaints and briefs and be forceful during any oral arguments in the courtroom.

Suits and requests for TRO, then preliminary injunctions are being prepared and should be filed next week. We wanted to have the complaints prepared as soon as the law hit, but it was changing up to the very last day of the legislative session, leaving little time to prepare in advance. The documents we are preparing to submit to the court will attempt to stop this heinous infringement on our gun rights and lay a foundation for future suits as we reclaim ALL of our Constitutionally protected rights. We are also carefully considering which federal court to file our lawsuit in as this can impact the course of litigation in multiple ways.



In addition to the suits that ASC and our partners will file, other organizations will file their own suits. At this time, we believe the Second Amendment Foundation and the ISRA will file complaints together, and the NRA and NSSF will partner to file one or more of their own.



We are planning on filing multiple complaints due to the sheer volume of stupidity that is demonstrated in this law. When combined, the number and complexity of arguments could be several hundred pages. This exceeds the size limits on a complaint and dictates multiple suits. This also ensures that a setback on one suit will not impact the progress of others.



Todd Vandermyde, Brian O’Neil, Glenn Byers, and Eric Callis have also started a 501(c)3 corporation, The Second Amendment Defense and Education Coalition, dedicated to defending the Second Amendment and educating Americans on the history, importance, and freedoms it has produced in the USA. It is not yet fully functional but will be very shortly. Once it is, we will accept tax-deductible donations to fund suits just like this and educate the bolshevik legislators that passed these totalitarian measures about what enjoying all the promises of America looks like.

In conclusion, I want to reassure you and reiterate that we will fight this as long and hard as it takes, and we will prevail. It is time to live your beliefs and self-rescue. If you don’t do it, nobody will. ASC is the largest private gun club in Illinois. It is time to lead from the front.
